Actor David Del Rio has been axed from Matlock due to allegations of sexual assault

“Matlock" star David Del Rio has been kicked off the CBS show ... and it's due to some serious allegations, TMZ has learned.

A source with direct knowledge tells TMZ ... David was escorted off the Paramount lot last week as soon as the allegations were reported.

We hear the actor has been accused of sexually assaulting actress Leah Lewis on Paramount property.

His character Billy Martinez -- one of the main ensemble of the Kathy Bates-starring reboot -- will be immediately written off, CBS Studios confirmed. He's appeared in at least 20 episodes, counting the ones yet to air this season.

The series has a pre-planned hiatus in October and November upon completion of the first half of the season. "Matlock" Season 2 premieres Sunday on CBS.

We've reached out to CBS Studios for more information and a rep for David for comment ... so far, no word back.

If there were a shot in hell he'd ever come back, they might have done something different. But, escorted off the lot and fired, rather than "suspended pending an investigation," then quiety fired later, really points to something egregious having happened.

I wonder how this type of misconduct is still happening. With big wigs, I get it. They can be on a power trip and hubris makes them think they won't face consequences. The investigation: After the report was filed, CBS Studios and the show's producers immediately launched an internal investigation.

Dismissal: On October 2, following the investigation, Del Rio was terminated and escorted off the Paramount lot.

Confirmation: Multiple sources, including Deadline and The Hollywood Reporter, confirmed the firing.

Aftermath:

Character written out: Del Rio's character, Billy Martinez, a first-year associate who worked closely with Lewis's character, will be written out of the show immediately.

Production impact: The show's creative team is now reworking scripts to account for the character's sudden departure. Filming for the second season continued after Del Rio's dismissal, with a planned hiatus in place.

The LA Times said there was already an investigation which led to his firing. For the show, this is a death penalty for him so they had to really uncover some concrete evidence or perhaps Del Rio confessed. Nonetheless, it's over for him.

I tried to get into this show but aside from Kathy Bates it's very mid. Del Rio was decent eye candy but his character wasn't essential. Unfortunately Leah Lewis was the more annoying of the two junior associates so I'd have rather seen her character go but whatever. I probably won't even bother with season 2 since the first was a chore to get through

She's been pursued relentlessly by the press since the news of his firing was released (which was weeks following the start of the internal investigation) and has been strictly been "no comment". Literally the only thing she's said publicly has been thanking her supporters. That tells me there is a a criminal investigation underway.

The only thing that I have an issue with is that they've broadened the definition of sexual assault so you can never be sure of what actually happened. Grabbing someone's ass is now sexual assault. In the end, it was a company decision. They conducted an investigation and felt there was cause to dismiss him. It is very interesting that the term "sexual assault" was used as well as the victim being named.

CBS is going to jump into action and fire him (not suspend him) to cover their asses. Fire him now, ask questions later. If he is found innocent of these allegations, they will make up an excuse of why they had to fire him anyhow (i.e.: he was trouble on the set, he didn't get along with producers, etc.).

Him not only being fired the same day as it was reported but also physically escorted off the set means that there was either incontrovertible evidence (witnesses or surveillance footage) or he admitted to the assault. Apparently there were only four hours between the reporting and the firing. So whatever they found to confirm the allegation, they found fast.

Legal wouldn't allow the showrunners to put the network at risk of a wrongful termination suit over some dubious he said/she said "sexual misconduct" type accusation. If there was any reason to doubt the allegation, they would have just put him on leave pending investigation.

I work in the film/tv industry, and they routinely make us take harassment classes all the time. Sexual harassment is very broad now: sending emails, videos, links, texts to anything remotely sexual (even commenting on appearance). I have a feeling it is in this category, since it's easy to prove.

Maybe that means there were witnesses gossiping about what happened from Sept 26-Oct2?

DO not confuse charges. SEXUAL HARASSMENT is a different charge and set of actions, than SEXUAL ASSAULT. Apparently this is sexual assault. Which, yes, can encompass many different actions.

There may be options depending on his story line. If the character put his career in jeopardy he may have been saved by episode end. But now they will shoot some new scenes, reshuffle already shot scenes, edit some scenes, and what do you know, they had to let him go. Or maybe he had an episode in which he had to be hospitalized for a day, and now it looks like there were some complications. For the writers this should be rather exciting.

I agree that some offscreen event explained in pure exposition would be lame.

I can't think of any way the CBS and Paramount legal departments would have executed this as quickly as they did unless there was hard evidence supporting the allegation--i.e. multiple eye witnesses and/or video surveillance.

CBS is basically Newsmax lite now--they're not some woke/SJW network. The allegations would have had to be egregious and the evidence damning for them to make a move like this.
