Actor David Del Rio has been axed from Matlock due to allegations of sexual assault
“Matlock" star David Del Rio has been kicked off the CBS show ... and it's due to some serious allegations, TMZ has learned.
A source with direct knowledge tells TMZ ... David was escorted off the Paramount lot last week as soon as the allegations were reported.
We hear the actor has been accused of sexually assaulting actress Leah Lewis on Paramount property.
His character Billy Martinez -- one of the main ensemble of the Kathy Bates-starring reboot -- will be immediately written off, CBS Studios confirmed. He's appeared in at least 20 episodes, counting the ones yet to air this season.
The series has a pre-planned hiatus in October and November upon completion of the first half of the season. "Matlock" Season 2 premieres Sunday on CBS.
We've reached out to CBS Studios for more information and a rep for David for comment ... so far, no word back.

Raised eyebrow. I know, believe women. But this also fits a bit the characters they play - Leah Lewis especially plays a ruthless backstabber. Why would David Del Rio be so dumb to "sexually assault" is main acting partner in his breakout role?

It's just an allegation. Apparently at some point it's morphed into "guilty until proven innocent."

Too bad - they actually had good chemistry together.
I also hate the fact that my first thought was that if he got escorted off the lot and fired immediately, the "allegation" must both have been pretty bad AND likely indisputable.
His career is over.

[quote]How the hell are they going to write his character out?
The usual - a very special episode.
He'll get killed off camera and the case of the week will be to solve who murdered him and/or defend a person wrongfully on trial for his murder.
If there were a shot in hell he'd ever come back, they might have done something different. But, escorted off the lot and fired, rather than "suspended pending an investigation," then quiety fired later, really points to something egregious having happened.

I wonder how this type of misconduct is still happening. With big wigs, I get it. They can be on a power trip and hubris makes them think they won't face consequences. But a regular actor should be smarter than that. In my organization there is training left and right on how not to behave. Might be different in the arts...

Details of the incident:
The allegation: On September 26, Lewis reported an alleged sexual assault incident involving Del Rio that occurred on the set of the show.
The investigation: After the report was filed, CBS Studios and the show's producers immediately launched an internal investigation.
Dismissal: On October 2, following the investigation, Del Rio was terminated and escorted off the Paramount lot.
Confirmation: Multiple sources, including Deadline and The Hollywood Reporter, confirmed the firing.
Aftermath:
Character written out: Del Rio's character, Billy Martinez, a first-year associate who worked closely with Lewis's character, will be written out of the show immediately.
Production impact: The show's creative team is now reworking scripts to account for the character's sudden departure. Filming for the second season continued after Del Rio's dismissal, with a planned hiatus in place.
No public comment: Neither Leah Lewis nor David Del Rio has publicly commented on the matter. CBS has also declined to comment on the internal investigation.

Obviously, the internal investigation found something, or he would have been suspended and not outright fired. The only thing that I have an issue with is that they've broadened the definition of sexual assault so you can never be sure of what actually happened. Grabbing someone's ass is now sexual assault. While no one should go around grabbing someone's ass without consent, it's not the same thing as rape.

No, but 'coming on to someone' can land you in HR with a mark on your file. Those two words matter more than what actually happen.

CBS is going to jump into action and fire him (not suspend him) to cover their asses. Fire him now, ask questions later. Him not only being fired the same day as it was reported but also physically escorted off the set means that there was either incontrovertible evidence (witnesses or surveillance footage) or he admitted to the assault. Apparently there were only four hours between the reporting and the firing. So whatever they found to confirm the allegation, they found fast.
Legal wouldn't allow the showrunners to put the network at risk of a wrongful termination suit over some dubious he said/she said "sexual misconduct" type accusation. If there was any reason to doubt the allegation, they would have just put him on leave pending investigation.

I work in the film/tv industry, and they routinely make us take harassment classes all the time. Sexual harassment is very broad now: sending emails, videos, links, texts to anything remotely sexual (even commenting on appearance). I have a feeling it is in this category, since it's easy to prove.

New York Post said incident happened on Sept 26, was reported (to HR?) on Oct 2, firing happened Oct 2.

DO not confuse charges. SEXUAL HARASSMENT is a different charge and set of actions, than SEXUAL ASSAULT. Apparently this is sexual assault. Which, yes, can encompass many different actions.
Sexual Assault (Criminal Law)
Definition: Any non-consensual physical sexual contact. It’s a crime, not just a workplace issue.
Examples of actions that constitute sexual assault: • Unwanted touching of intimate areas (breasts, buttocks, genitals). • Kissing, groping, or fondling without consent. • Forcing or attempting sexual acts (rape, oral sex, penetration). • Physically restraining someone to make sexual contact. • Sexual contact while the victim is incapacitated (asleep, intoxicated, or under threat).
Sexual Harassment (Civil / Employment Law)
Definition: Unwelcome verbal or non-physical conduct of a sexual nature that affects employment or creates a hostile work environment. It’s generally addressed under Title VII of the Civil Rights Act (via the EEOC).
Examples: • Sexual comments, jokes, or innuendo at work. • Unwanted propositions or requests for sexual favors. • Displaying sexual images or sending explicit messages. • Repeated remarks about appearance or body. • Retaliation after rejecting a sexual advance.
This can be: • Quid pro quo harassment (“sleep with me or lose your promotion”). • Hostile work environment harassment (repeated or severe conduct that interferes with work).
Handled by HR, EEOC, or civil courts, not criminal courts (unless physical contact occurs).

[quote]I wonder how this type of misconduct is still happening
You wonder how sex pests are still being sex pests? This isn't something that goes away after one sensitivity training or because some muckety-muck put out a strongly worded memo. People like this are pathological, and they operate within a toxic male culture that encourages bad behavior.
I share your disgust but I don't think sexual misconduct will ever completely go away.

r120 somewhat tangential, but many years ago, I worked with a serial sexual harasser/probable rapist.
Evidence suggested he assaulted two women, although nothing ever came of it, either criminally or civilly. One was morbidly obese and in her 20s, estranged from her family without much social support. The other was in her early 70s, also estranged from family and without much social support. I think he knew -- probably on an instinctual level -- that people would assume that he, an attractive man in his 40s with an attractive wife, would have no interest in socially undesirable women and that raping them was more or less a safe bet for him.

[quote] They’ve already shot the first half of the season.
All the more reason to recast instead of fire. If half the season’s storylines have been shot already that means we will never get any resolution to those storylines. If he was recast, we could still see those storylines play out as originally written. Now we just get some awkward BS transition that he had to suddenly quit and that won’t be true to his driven character. And if they kill him off that would really make the show jump the shark.
by Anonymous | reply 146 | October 10, 2025 7:10 PM

There may be options depending on his story line. If the character put his career in jeopardy he may have been saved by episode end. But now they will shoot some new scenes, reshuffle already shot scenes, edit some scenes, and what do you know, they had to let him go. Or maybe he had an episode in which he had to be hospitalized for a day, and now it looks like there were some complications. For the writers this should be rather exciting.
I agree that some offscreen event explained in pure exposition would be lame.

Of course that's not all there is. Clearly, this is the lie he told his wife when he got fired. And frankly, if she believes him, she's quite the idiot. His wife, before she was his wife, was actually a superfan who ran up to him outside a stage door to get his autograph, and then they started dating. She's delulu and he loved being worshipped.
You really think he would have been immediately fired and escorted off the set for posting a video that a co-worker found offensive? And that this would have been classified as "sexual assault"?
Don't you love how all the "don't rush to conclusions before we have all the facts and also women are lying whores!" posters here are now reporting the claims of this guy's adoring, defensive wife as if they are established fact. R181 Getting dropped by your agency is not the same as being suddenly fired as a SAG member when you're in the middle of a contract with a major network and studio. The latter can result in an enormous wrongful termination lawsuit if serious cause for said termination cannot be provided.
I can't think of any way the CBS and Paramount legal departments would have executed this as quickly as they did unless there was hard evidence supporting the allegation--i.e. multiple eye witnesses and/or video surveillance.
CBS is basically Newsmax lite now--they're not some woke/SJW network. The allegations would have had to be egregious and the evidence damning for them to make a move like this.

He had a nice weird goofy personality and was friendly but none of the attractive girls wanted to date him because they got a creepy uncomfortable vibe from him.
Turns out he started paying attention to all of the plain and fat girls and he was always taking them out in the woods and mostly getting blowjobs from them.
No-one was raped or coerced because it was mutually consensual but he definitely exploited those poor girls for his own personal satisfaction.

Have you noticed that David's people haven't made any official statement denying the allegations (outside of a couple of quickly deleted posts from his unhinged wife)? That's because it's very likely the evidence was solid enough that his lawyer is quietly advising him not to set himself up for a defamation suit by running his mouth.
