So, this Congress, which barely exists anymore except on one magical night to pass the big bullshit bill, is going to make it a federal law that the individual states MUST allow same-sex marriage? And this SCOTUS, which apparently in this dream world would have just got done saying it's not a constitutional right, is going to uphold that federal law against a "states rights" challenge? Uh, huh. Or even more laughable, this guy thinks that Congress would approve a constitutional amendment protecting same-sex marriage and three-fifths of the states would ratify it? Either scenario is beyond absurd.
The best chance for same-sex marriage to remain the law of the land in the entire U.S. is for SCOTUS to not revisit the decision. And I hope (and think) there's a good chance they tell the Davis bitch to take a hike and decline to revisit it.

I doubt the Biden-era Respect for Marriage Act survives a court challenge in front of a Court that would overrule Obergefell. Overruling Obergefell would be a very aggressive, ideologically driven, and disruptive move. All of the practical factors concerning stare decisis counsel against overruling it. If they do it, it's because they want same-sex marriage gone so badly that they're willing to do great damage to do so. And I don't think that law survives in front of a Court like that. It would be found to infringe against the rights of the states or some similar nonsense.
I'm hopeful (and I think) that they have no desire to even consider opening that can of worms. My guess is that they don't even hear this case.

While Obergefell v. Hodges, the Supreme Court case that legalised same-sex marriage nationwide, remains the law of the land, the Respect for Marriage Act provides additional federal and state-level protections and ensures that same-sex and interracial marriages are recognised even if Obergefell is overturned.
If I were a lawyer, my argument for gay marriage would be, it is a check box on your tax return and therefore recognised federally. There are FEDERAL tax advantages to filing married that are denied to same sex couples if they cannot get married. That alone should qualify for same sex marriage. Taxation without representation.
