But that's NOT the lien on the condo that forced the sale of the property. It was an entirely different lien that one of her lenders had on the property based on a loan she got from them back in 2015.

And this is just a standard agreement. You get a loan against your property, and if you default on the loan, then the lender has the right to sell the place to recoup their money. She signed off on that, and if you read how the auction sale itself was accomplished, it actually states that the sale was "executed by Brenda Dickson Weinberg" because of agreement she signed (notarized and officially filed with the county).

I think she's still moaning about the HOA because she's looking for a villain to blame, so in her narcissistic brain she thinks she can spin that story to garner more sympathy than, "I'm flat broke and defaulted on my loan."

Here's part of the page where it states what the Trustor (BrendaD) is agreeing to. Note the part about the Trustor granting the Trustee (the lender) Power of Sale.

The last page (in next post) is the signature page, witnessed and notarized.

I’d never heard of Brenda Dickson but this is all fascinating in an odd way. It’s a shame she’s so delusional at 75 but it doesn’t seem like that’s anything new in her life.

Oddly enough, why I registered and decided to post is I did create a You Tube page for someone who really does post very creative and entertaining TikToks and makes her own clothing and art and isn’t a publicity hound. At all. Which is odd considering she makes all these truly entertaining TikToks. The costumes include spot on replicas of movie characters (A Clockwork Orange, Mary Poppins, Spider-Man and on and on, you get the idea), rock stars (Tina Turner, David Bowie, and again many more), then there’s her own costumes and her own art. She’s definitely got mixed feelings about the You Tube page, but I made it because she’s extremely entertaining, funny - she can do double jointed imitations of a young Jim Carrey from Ace Ventura and such - quite athletic even at 51 - and prolific. I posted 379 of her videos there - some, like her doing the opening to The Simpsons - I can’t post because You Tube doesn’t have the music rights - and I downloaded thousands of her videos to my phone because I found them to be unique and worthwhile. I’m not exactly sure what to do with them from here, but I always thought from the moment I came across her she was a television star. By this time, she’s aged out but the videos remain very much a testament to her work and creativity. I really thought they deserved to be archived.

If she had any sense of reality, she would have sold the property and acquired the equity. Now she is going to get dumped out on her ass with absolutely nothing! There is no other possible outcome. Hopefully she has some boxes and is packing up her stuff. Otherwise, she will end up with nothing but the clothes on her back.

There was a secondary HOA fee-assessment for $40,000 added right after her mother passed away, which her step-father agreed to pay, because he was the one who was going to be living there. So another one added, some 15 years later for $60,000 (per her last video) to be paid over time doesn't seem that outrageous. The lien from the HOA shows that the secondary fee they wanted her to pay amounted to an additional $360 per month. One imagines that being on a fixed income that would really cut into her potatoe shalad budget.

One of them is on how the HOA Board authorized the President to carry out this action, and another covers delivery of the Pre-Lien Letter. Keep in mind, this is when BrendaD still had legal representation and wasn't representing herself, so those FACTS were not in dispute:

As I've said before, one of the lenders forced the sale to recoup their loan ($135K). Her other loan on the place is for $150K. She's supposed to make monthly payments plus interest on it, but we don't know how much she might owe on it currently. It comes due in 2045. Then, there are the delinquent property taxes now at $19K. So that's already over the $285K the condo sold for.

The HOA lien is subordinate to other liens. That's in the Stirling-Davis Act as well. So if there's nothing left over, then they'll get nothing from the sale.

R297 As I wrote once before, that July 26th date is just the last day within the 60-day window for when the new owner said he intended to occupy the property when the trust deed was filed (May 27). And that's just a fairly standard statement required with these type of auction sales. I wouldn't necessarily think that date would be the day she'd be evicted, though. We'd have to know where the new owner is in the process of trying to get her out of the place.

I think we can assume that she ignored the "3-Day Notice to Quit" (otherwise she would have already left the place on her own). So she probably had to be officially served with an "Unlawful Detainer Notice" I believe she would then have had 10 business days to respond to that wherein she would have asked for a court hearing on the matter to be scheduled. If she requested that, then it could take something like a month from the date of her filing for that to happen. That's just an approximation. It's also just a guess that we're in that "waiting period," because of something she recently said about "at least the pounding on the door has stopped."

btw - I've been reminded that this is not like a landlord-tenant eviction where a landlord generally has to prove why they should be able to evict a tenant. Instead, she has to prove why she should still be able to reside there. Hard to do, given the original loan document that she signed; plus it appears that the trustee sent her all the applicable notices and did all the required due diligence over the last YEAR that this has been going on. (The first notice of default started back in August 2024 noting the consequences if she didn't take action.)

And whatever the outcome, no ruling in this hearing is going to make any of the liens go away or excuse the property tax bill. It's pretty obvious that she can no longer afford to live there. And whenever she's not paying the HOA fees, the property taxes, and insurance, she's in violation of her loan agreements.

She seems well behaved enough. Sure, she’ll ramble on about her home being stolen and crime cydikits, but that’s part of charm at this point.

It’s a sensible idea so I am 99.9% sure it’s something she would never do.

I remember around the time she came back from Hawaii, she actually showed up at the Daytime Emmys (2009).

Of course, at that point, she probably still had enough cash to buy a ticket, and they were being done on the cheap and broadcast on The CW that year.

Also, in the appellate court's summary of her divorce case in Hawaii, it's noted that she had requested alimony of $25,000 per month for five years, because she needed that much money to resurrect her acting career, which she'd given up during her marriage, so apparently at that point her stated intent was to to get back to acting.
