I don’t think you can copyright a design. They’d have to rely on Trademark law and it’s unlikely anyone is actually confused by this.

The Birkin is not exactly an attractive bag but it's good for people who like totes. I'm sad to hear that the creative director for LOEWE is leaving. He expanded the brand to a whole new level with his innovative designs.

Actually you can get a DESIGN patent as apposed to a utility patent. The problem is design patents are weak protection since all you have to do is change one tiny detail and it's not longer the same design. Now if there was something unique about those bags as to how they work or are constructed (which there is not) then they could lock down the design legally.

But interestingly enough you can actually buy a grotesquely overpriced real Birkin through Walmart at fantastical prices.
