Footage shows New York correctional officers brutally beating handcuffed inmate to death

NEW YORK (AP) — Newly released video of a fatal New York prison beating shows correctional officers repeatedly pummeling a handcuffed man, striking him in the chest with a shoe, and lifting him by the neck and dropping him.

Body camera footage of the Dec. 9 assault on Robert Brooks was made public Friday by the state’s attorney general, who is investigating the officers' use of force.

Brooks, 43, was pronounced dead at a hospital the morning after the assault at the Marcy Correctional Facility, a state prison where was incarcerated in Oneida County.

Thirteen correctional officers and a nurse implicated in the attack will face termination, according to New York Gov. Kathy Hochul, who said she was “outraged and horrified” by videos of the “senseless killing.”

The footage made public Friday shows correctional officers repeatedly punching Brooks in the face and groin as he sits handcuffed on a medical examination table.

As one of the officers uses a shoe to strike Brooks in the stomach, another yanks him up by his neck and drops him back on the table. The officers then remove the man’s shirt and pants as he lies motionless and bloodied on his back.

“These videos are shocking and disturbing and I advise all to take appropriate care before choosing to watch them,” New York Attorney General Letitia James said.

Preliminary findings from a medical examination indicate “concern for asphyxia due to compression of the neck as the cause of death, as well as the death being due to actions of another," according to court filings.

The videos do not include audio because the body cameras had not been activated by the officers wearing them. The state’s Department of Corrections and Community Supervision issued a directive in the wake of Brooks’ death requiring that staff use body cameras in every staff interaction with incarcerated people.

James said her office was investigating the use of force that led to Brooks' death, but did not say whether any of the officers would be charged with crimes.

“As viewers can see, Mr. Brooks was fatally, violently beaten by a group of officers whose job was to keep him safe,” Mazur said. "He deserved to live, and everyone else living in Marcy Correctional Facility deserves to know they do not have to live in fear of violence at the hands of prison staff.”

The union for state correctional officers, which viewed footage of the assault before its public release, said in a statement: “What we witnessed is incomprehensible to say the least and is certainly not reflective of the great work that the vast majority of our membership conducts every day.”

“This incident not only endangers our entire membership but undermines the integrity of our profession. We cannot and will not condone this behavior," said the union, the New York State Correctional Officers and Police Benevolent Association.

Brooks had been serving a 12-year prison sentence for first-degree assault since 2017. He had arrived at the Marcy Correctional Facility only hours before the beating, after being transferred from another nearby state prison, officials said.

Marcy is about 200 miles (323 kilometers) northwest of New York City, between the cities of Rome and Utica.

The Correctional Association of New York, a prison oversight group, said it had documented reports of pervasive brutality and racism inside the Marcy Correctional Facility during a monitoring visit two years ago.

I saw this story on the news today and was totally sickened.

I watched the video because I couldn't move I was so horrified. There was no sound because the guards deliberately made sure it wasn't on. The guards literally beat him to death on video and he was dead but still alive somehow long before he actually died. It must have been a fucking miserable and TERRIBLE way to die. The video was absolutely brutal and he was treated worse than a rabid animal. It brought tears to my eyes. The story said the victim was serving 8 years for stabbing his girlfriend so he wasn't a good person. However, he wasn't given a death sentence by the courts - even though he received it.

The problem is that by the hand of fate anyone could find themselves in this position and die at the hands of prison guards. This is unacceptable.

The story reported all guards are being investigated and were suspended and one guard has so far quit. All of them should be charged with murder.

This might make me a terrible person, but my empathy is finite. I'll save it for the inmates that are exposed to gross human rights violations and not the guards who are occasional casualties, especially given that I suspect a sizable number of guards are attracted to their positions because it allows them to abuse other human beings without reproach.

Details of Brooks' death were outlined in the state investigator's deposition filed Tuesday by New York State Police.

The deposition was filed by Ryan Paparella, an investigator for the Department of Corrections and Community Services and was brought in to review this incident. In the deposition, Paparella , details his assessment of the body camera footage showing Brooks' attack.

Paparella did not mention any apparent provocation or motive in his deposition and noted Brooks had his arms and legs restrained throughout the 15-minute assault. Paparella is a former corrections officer at the same prison where the incident took place.

Paparella's deposition stated: "The male was on the ground [outside near a fence]... I observed correction officers pick up the male off the ground who was handcuffed with his hands behind his back. The hands of the black male were extended directly above his head as his upper torso was parallel with the ground. They continued to walk the male down the sidewalk and towards an open door of the infirmary."

Paparella reported a corrections officer delivered a "closed fist strike to the chest" while Brooks was handcuffed, and detailed officers pushing Brooks' body up against an interior window.

Preliminary findings of Brooks' autopsy by the Onondaga County Medical Examiner's Office, "show concern for asphyxia due to compression of the neck as the cause of death, as well as the death being due to actions of another," New York State Police wrote in a court filing.

Paparella detailed that two sergeants and a nurse watched the attack and neglected to intervene. They are among the 14 prison staffers whom New York Gov. Kathy Hochul ordered to be terminated by the state.

The Correctional Association of New York (CANY), a state oversight group, said in a statement that terminating staff involved in the incident "is a good start, but Governor Kathy Hochul and the legislature must go much further."

"They need to take bold and courageous actions to fulfill past commitments and bring about a new era of transparency and accountability in state government," the release reads.

Also? Please remember that there’s a good chance these monsters went home after this shift, and beat the shit out of their wives and/or children. If they didn’t do it after the shift, they have certainly done it by now.

Not to be pessimistic, but even if you believe this isn't okay, this video won't change anything at all. Policies will remain the same and a good portion of Americans, as shown by who they just elected, will twist themselves into knots to justify it. If the officers are charged, and that isn't a guarantee, the punishment will not be significant. It will happen again and in a day or two, the media will be back to 24/7 coverage of Trump's antics. That's the pattern and the type of country we live in. You don't have to agree with me, but you know I'm not making this up.

I don’t believe a word they say, especially after watching the footage where the cops are attempting to shove a white towel into Mr. Brooks’ mouth. They do this in order to muffle the screams of the prisoner who is about to get a beating. If they were genuinely concerned about Mr. Brooks biting an officer, they would have placed a mouth or face guard on Mr. Brooks, in order to protect themselves

They knew what they were doing, and at some point before the footage was shot, at least one corrections officer or more, knew what he/they were about to do, & IMHO, that makes this homocide premeditated.

Earlier in the day, he had been transferred from Mohawk Correctional Facility to Marcy and beaten by corrections officers in a medical examination room, while handcuffed with his hands behind his back. Body camera footage shows officers repeatedly punching and kicking Brooks in the face, chest, and groin until he stops moving.

The New York Attorney General’s Office of Special Investigations has opened an investigation into Brooks’ death. Attorney General Letitia James pledged Friday to “use every possible tool available to us to investigate this death thoroughly and swiftly” and described the footage of the beating as “shocking and disturbing.”

It is difficult to draw conclusions about the situation because the video footage does not capture any audio or show what led up to the violence immediately preceding Brooks’ death. But in the opinion of several experts who reviewed the video, the footage showcases an excessive use of force by officers as well as a failure by other officers to intervene.

“I can’t believe the excessive force that these corrections officers used,” Michael Alcazar, a retired NYPD Detective and adjunct professor at John Jay College of Criminal Justice, told CNN Friday.

Here’s more on what experts said about the video.

Several law enforcement experts who spoke to CNN criticized the corrections officers’ use of force shown in the footage.

Brooks, 43, seemed to be compliant with officers and not posing a threat as officers beat him, making the use of force potentially excessive under the law, according to Bryce Peterson, an adjunct professor at John Jay College of Criminal Justice and a senior research scientist at the Center for Justice Research and Innovation.

“Just because someone is handcuffed does not mean they cannot be subjected to force,” Peterson told CNN Friday. “However – and this is a big however – if someone is no longer a direct threat to the officers and is complying with instructions, it would certainly be excessive to strike them, choke them, etc.”

From the body camera footage, it is unclear what led up to the beating or why Brooks was taken into a medical examination room by officers as the footage first shows Brooks face down and handcuffed as three officers carry him into the facility.

A 1992 US Supreme Court ruling, Hudson v. McMillan, set the standard for police use of force, said Peterson, who was part of a team performing the first evaluation of a corrections body-camera program at a jail in Loudoun County, Virginia. The ruling established force is “only justified when it is used to maintain or establish discipline,” Peterson said.

Peterson said potential excessive use of force is “particularly” evident “when officers are cleaning blood off Mr. Brooks’ face and then begin to strike him and continue to strike and grab him for the next 30 seconds.”

Prosecutors could consider a range of charges, said Peterson, similar to the range of state and federal murder charges against four officers in the 2020 killing of George Floyd in Minneapolis, which included a charge of murder against the lead officer, as well as abetting manslaughter, failing to stop unreasonable force and deprivation of civil rights for the other officers at the scene.

At least three of the officers involved in the fatal beating of Robert Brooks, a New York man held at the Marcy Correctional Facility in upstate New York, were previously accused of assault, according to court documents obtained by CNN.

The officers were among 14 staff named by the Department of Corrections related to Brooks’ death. None of the officers have been charged with wrongdoing.

Two of the New York officers, Sgt. Glenn Trombly and Officer Anthony Farina, were named in a complaint filed in federal court in 2022, based on a 2020 incident which occurred at the same prison where Brooks died.

The complaint alleges as another correctional officer beat a handcuffed inmate at the correctional facility, Trombly and Farina “looked on and failed to intervene in any manner to prevent or stop the beating,” leaving the plaintiff with “a permanent facial deformity.” The case remains pending.

CNN has reached out to the plaintiff’s attorney for comment.

A different officer, Nicholas Anzalone, who was named by the department, is also named in a separate federal complaint in 2022, stating he joined an assault on an inmate by another correctional officer at the same facility. The complaint alleges the officer was involved in a cover-up fabricating disciplinary charges against the inmate, who was left with “substantial physical and mental injuries.” The case is still ongoing.

Court documents detailed the incident. “Defendants CO Nicolas Anzalone … entered the bathroom during the assault and joined CO Iodice in kicking Plaintiff while he lay on the ground and/or failed to stop CO Iodice’s assault … After beating him, Defendants took Plaintiff to the Marcy infirmary in a van wherein they forced Plaintiff to lie face down on the floor while CO Anzalone kicked his feet.”

Rosenfeld added, “If DOCCS (the Department of Corrections and Community Supervision) had done anything about the officers at Marcy who it knew were routinely terrorizing incarcerated people, Mr. Brooks would still be alive today.”

What if you had been falsely charged or even legitimately charged with a crime you did not or did commit? What if you were brutally murdered in this manner?

So by your logic, R102, you deem persons on DL to have enough integrity & morals to not murder inmates, if DLers signed up to become corrections officers.

Guess what? Most of here have not. In this, you’re correct.

But what about those men who did? You think that just because they signed up for the job, they have the right to mercilessly beat and/or murder inmates?

Somehow, I’m pretty sure they are not allowed to do that, yet these men did just that. Why don’t you stop making excuses for human scum, and start holding THEM responsible for breaking the law?

Or is that something you’re unwilling to do?

I’d love to hear why multiple corrections officers should be allowed to beat a handcuffed man to death, yet average citizens aren’t held to the same standards, & would be immediately incarcerated if they did just that.

“I have been thrown against the wall, head smashed against the wall, as well as rib shots that have bruised my ribs – our freedom in life has been threatened,” said Williams, who is serving a 3.5-year sentence on a gun charge.

Williams told CNN both he and his family have attempted to file reports with the Office of Special Investigations at the state’s Department of Corrections and Community Supervision, but he doesn’t have much hope that things will change.

“This Marcy Correctional Facility is run by a mob,” he said.

CNN provided the DOCCS with the case numbers for Williams’ complaints and a department spokesperson responded Tuesday, confirming Williams has been interviewed by an OSI investigator and that the review of his case is ongoing.

Since Brooks’ death, New York Gov. Kathy Hochul has announced she will appoint a new superintendent at the prison. The state corrections department has also named 14 staff connected to Brooks’ death; as of December 31, none of the officers has been charged with wrongdoing.

Experts and attorneys who spoke to CNN said over the years, Marcy Correctional Facility has developed a reputation for being a place where inmates often experienced violence, intimidation and racism at the hands of staff.

Jennifer Scaife, executive director of Correctional Association of New York (CANY) – the independent ombudsman tasked with monitoring the state’s 42 correctional facilities – told CNN she’s confident any investigation into the prison would reveal the attack on Brooks was “not an aberration.”

“It’s really been a facility that we’ve heard a lot of very troubling allegations out of for quite some time,” she said. “I think what will be shown … is a pattern and practice of brutality and violations of people’s human and civil rights.”

Replacing the superintendent is only one step forward. This was not one bad egg. There is an obvious lynching mob mentality by the correction officers. If all those involved are not fully prosecuted, there will be no reason for the rest of them to continue this practice.
