Inside the Trump team’s plans to try to end birthright citizenship

President-elect Donald Trump’s team is assessing multiple options to fulfill his long-promised pledge to end birthright citizenship, according to two sources familiar with the discussions, teeing up a legal fight with the expectation that the Supreme Court would ultimately have to rule on the matter.

“We’re gonna have to get it changed, or maybe I would go back to the people, but we have to end it. We’re the only country that has it,” Trump told NBC’s Kristen Welker, echoing a false statement he’s made in the past. “If we can, through executive action. I was going to do it through executive action, but then we had to fix Covid first, to be honest with you.”

Trump allies argue that the 14th Amendment has been misinterpreted and doesn’t apply to children born in the United States to undocumented parents. Some immigration hardliners have argued that children of undocumented immigrants are not “subject to the jurisdiction” of the US and shouldn’t be considered citizens under the Constitution.

Transparent bullshit. If they are not “subject to the jurisdiction” of the US, then ICE has no authority to deport them.

Do you really want Trump and his minions monkeying with our Constitution? The 14 Amendment is what guarantees due process and equal treatment under the law. Trump is only going after it because it's where those who "engage in insurrection" are disqualified from holding office.
