Daniel Penny: Not Guilty
A Manhattan jury has cleared Daniel Penny of criminal wrongdoing in the chokehold death of Jordan Neely on a crowded subway — a caught-on-video killing that sparked fierce debate over the city’s mental health system and crime underground.
The panelists acquitted Penny of criminally negligent homicide — which could have put him behind bars for up to four years — in Neely’s chokehold death aboard a crowded uptown F train in May 2023.
Manslaughter, the top charge against Penny, was tossed on Friday after jurors twice said they couldn’t reach a unanimous verdict.

I know some activists will say this was jury nullification but it truly wasn’t. The dude was acting outrageous, intimidating, and threatening to kill people. Obviously Penny could have shown more restraint towards the end but there were also 2 black dudes holding him n down in the beginning. This isn’t like that dude in the 80s. Interesting. R8, they noted Penny was steady throughout and never escalated his chokehold. That played in his favor. They also noted it was not racial because black people on the train were afraid of him. too. The guys helping hold him down were black.
R9, I think they showed up for the pay day. I don't believe his father was present in his life, yet he's been front and center during this trial. Matter of fact, at the time of his death Neely had an active warrant for assault.
Other crimes include:
August 2015 - arrested for trying to kidnap a 7 year old girl.
June 2019 - arrested for punching a 64 year old man in the face. ON THE SUBWAY.
2021 - punched a 67 year old woman in the face. ON THE SUBWAY.

I do believe that Penny would have done the same thing if the person had been white or any other race.
If the deceased had mental health issues, it's sad that they weren't addressed. But, let's be clear, whether you're mentally ill and kill someone or sane and kill someone, the other person is just as dead.
Now, we can debate whether Penny's response was "proportional" or not. But, for those who don't think it was proportional, I question what other options there were under those conditions. It seems like the actual choices were to be ineffectual or this potentially "disproportional" response. Sometimes, there isn't a middle ground.

Self defense was established so the state was arguing that excessive force was applied and at some point Penny chose a lack of regard for Neely’s life. That is a very hard thing to prove because we won’t all die from chokeholds at the same length of time. It’s going to vary from person to person. It also becomes difficult to prove when the victim has threatened to kill people by multiple witnesses, patrons on the train.

What I want to know is why the judge dropped the manslaughter charge when the jury had hung on it. They then found him not guilty of the lesser charge, negligible homicide which we can presume then they would have ultimately found him not guilty on manslaughter. Legal scholars can you weigh in. I’ve never heard of a jury hanging on a charge and then the judge just dropping it. Would the prosecution have to agree to it?

Well, in case anyone is interested, I would guess that a Federal Civil Rights civil complaint will be filed against Penny (by Neely's parent et al) in what, anything from a week to a couple of months from now, at which point in time he will have to go through all of his all over again a second time around.

The morality and culture is created by poverty. We ALL would commit crimes if we had that background. This has been borne out by looking at culture after culture, all over the world. The middle class and above have no reason to commit violent crimes

R223, I've posted a few times on this thread on The DL and avoid revealing too many facts about my life given the crazies on this site.
I have been a psychiatric nurse in NYC for a decade. I completely agree with you and I have been an advocate for humane asylums. Most mentally ill people are not violent, but some are, especially when drugs are involved. There is a fairly large population of the mentally ill that the old model of asylums with humane living situations, access to nature, routines, etc. is the best we can give.

I love Freddie DeBoer (he writes on Substack, for anyone who's interested). He suffers from bipolar disorder and knows the struggle of mental health from the inside, including having spent time in institutions.
He's written extensively, and angrily about the "compassion" that says people who are obviously too fucked-up to care for themselves shouldn't be made to do anything they don't want to do. They can sleep on a snowy sidewalk in winter; they can shoot up in their necks because their arms and legs are necrotic, and then hunch over in a near-death zombie state; they can shuffle around barefoot in shit-caked clothes screaming in rage at anyone and anything. But it's "compassionate" to leave them to it, if they don't want to go to a shelter or to treatment.
My personal definition of "compassion" is: If this person was my son or daughter, my sister or father, what would I want to see happen to them? Would I want them to be able to refuse treatment, even if it meant dying literally on the street?
Freddie de Boer argues that, for so many "compassionate" progressives, the answer is yes. The will of a desperately sick, mentally impaired, trauma-scarred, drug-addled individual must never be violated, or it's not "compassionate."
And as for the working people who daily witness this drug use, stacks of dirty needles, fires, random piles of human shit, terrifying and often threatening behavior? They are privileged, so they don't deserve "compassion."
