I feel like an adult should have the right to this but not a kid. Kids are often wrong or change their minds. They aren’t mentally developed yet. This isn't like chemotherapy to cure a child of cancer, or a blood transfusion to treat a child for haemophilia. It isn't orthopaedic surgery to straighten a leg so a child will be able to walk properly and prevent further damage to ankles and hips.

This is hormone treatment to treat psychological distress. Hormone treatment which suppresses a child's natural growth, which doesn't have any research into the long term effects on adults who have gone through this and which has no research to show it offers children psychological relief. The independent Cass report in the UK is the most comprehensive research into this.

Does the US have any case history on consent/capacity for children and healthcare?

When Keira Bell took the Tavistock to court a few years ago she initially won but it was overturned on appeal. There were a lot of TRAs claiming any ruling in favour of Bell would remove the Gillick principle on a child's capacity but it is clear that children of 11/12 starting blockers are unable to make decisions on future fertility and sexual function.

While there are various reasons people have for being for or against the Tennessee law, the claim before the court is that the law violates the equal protection clause of the 14th Amendment. The District Court said yes, but the appeals court overturned the ruling. That's what the SC will be ruling on.

Wait until you’re 25, when your brain is fully formed and you’re an adult to make that choice. I’ve a friend whose then daughter asked to be put on testosterone to transition. She was 16. My friend was sick about it. She didn’t want her kid on hormone therapy but she feared her kid’s mental health would spiral if she was denied. Now the kid is in their 20 and has to take testosterone the rest of their life. During the pandemic, they couldn’t get the hormones consistently and a whole lot of drama ensued.

Anyway, several European country’s are enacting rules to ban it until 25. This isn’t anti-trans, rather it’s concern of the kids’ health/safety.

There are plenty of instances where the government, in fact, does know better than parents the sort of medicine is appropriate for a child.

There was a time when vaccines were required to enroll in public schools - no vaccine, no school.

And, of course, let's not forget that the government has just determined that women should not have universal access to a medical procedure to terminate a pregnancy - even when the life of the mother is endangered (don't let them fool you - the laws are so rigid that women's lives are at risk).

Hell, the entire medical profession in the US is regulated by the government through hospital accreditation, doctor licensing, nurse licensing and countless other requirements. It prevents untested and unproven procedures, regulates medication and its uses, and requires clinical trials and extenstive testing.

Let's not pretend that the government as always been agnostic to the "medical" and healthcare choices of parents.

The reality is these procedures have not had sufficient time to gauge the true impact physically, let alone psychologically, on children who depend on parents to make informed medical decisions, but who may be, unfortunately, driven by their own personal agenda.

At present in the UK kids who were given blockers by the Tavistock clinic stopped their care with Tavistock when they turned 18 and are effectively lost to follow up. So Tavistock are unable to say how many went on to surgery etc.

One recommendation of Hilary Cass is that the NHS teams looking after ‘gender confused children’ carry on specialist care until the patient is 25 - this is a model based on the Teenage Cancer Trust. This will allow better data on patient groups to be obtained.
