I read a good portion of his 21 page declaration. It's obvious that she stalked him. He supplied emails and hours of voicemails with his declaration. The heart of Harvey's lawsuit is that the series states that she went to prison twice for stalking and Netflix has admitted that she was never jailed.
This whole thing is a mess because Netflix advertised it as a true story versus saying "based on" or "inspired by" a true story. Also, in his declaration Gadd states "the series is not a documentary representing literally true details and imagery. It is a fictionalized retelling....." and where he was going with that was to say this is not about a real person named Fiona Harvey; it's about a Martha. But we all know Martha is a stand-in for Fiona.

I haven’t watched the show but am aware of the legal action. In the show, does he use his real name while using a fictitious name for his stalker? If yes, then it seems it’s easy enough to say it’s “not” about her, even though it is about his experience of being stalked (by her). But not her.

Fake names for himself and his stalker and other abuser.

Obviously that was never going to work: if you’re selling something as based on real life, people will want to know who these people really were. They will want the “real” story. Did no one think that crazy Fiona was not going to come out of the woodwork?
