In my jurisdiction, you can choose the breath (Intoxylizer, FKA Breathalyzer), urine or blood.

They don't test for drugs if you get a DWI. They just thow you in jail overnight to sober you up and then release you the next morning.

They do in fact do a blood draw if you're not drunk but otherwise impaired. I still don't know how they determine if you're "too high" to drive. I think some states are having problems with that. Umm, that’s not how it works. There is no “ticket” for drunk driving. It’s a criminal charge. Have you heard of MADD? Because they’ve been fighting for years to make the DUI laws as strict as possible.

If you refuse tests, a police officer can testify regarding: the smell of alcohol, slurred speech, red eyes, alcohol containers visible in the car, weaving on the road, running red light, speeding, etc.

If you refuse tests, the DA or prosecutor will not be able to say: His BAC was 0.8 or 1.4 or whatever.

There is no legal advantage to refusing a breathalyzer. The only *possible* outcome is by doing so, by the time they take you to the station and compel a blood test, you may no longer be legally intoxicated. This happened to a friend. He kept drinking water (going to the bathroom) and by the time they tested him he was below .08. They let him go but impounded his vehicle for 24 hours. He learned his lesson after that. Not all do.
