6'6"/ 260 lb Punk singer launches himself into crowd and paralyzes young woman
Apparently the Buffalo music venue had signs posted everywhere forbidding moshing/crowd surfing and had included the policy in the band's contract.
2-minutes into the first song of their set, the enormous lead singer of pop punk band Trophy Eyes heaved himself without warning off the stage into a small group of concertgoers standing in front of it, including tiny, 24 year old mega-fan Piche, partially paralyzing her in the process.
This isn't the first time he's injured people doing this and when fans have expressed concerns about it on twitter, his response was simply, "fuck you". The band has since expressed their deepest sympathy for the girl whose life will forever be altered and who will likely never walk again, calling it a freak accident. They have also contributed $5,000 to the Go Fund Me page created for her. While they did end the show early, they have not cancelled the remainder of their tour.
Some Trophy Eyes fans are saying that's what you sign up for when you go to punk shows. What do you think?

[quote]forbidding moshing/crowd surfing and had included the policy in the band's contract.
I don't think a jury will care that the venue put it in the contract, thinking that it would insulate them from damages should the band defy the contract.
Also, arrest the punk singer. Maybe the band, too, if they've allowed it to happen before.
But IANAL.

The victim seems to be trans or nonbinary, based on the array of pronouns used in posts by their friends and friends of their mom, but it's irrelevant to the story.
The singer sounds like a reckless idiot who is unlikely to change his behavior.

Stage diving and moshing have been a thing for almost 50 years. If you go to a punk show and are small/a female avoid the pit. I apportion the blame 80/20. 80 to the 6'6" moron who thought a man of his size sshould be stage diving and 20 to the Gen Z snowflake who thought she belonged in the mosh pit of a punk show. Of course she is gonna be unsafe. Both of these idiots have had their lives changed forever.

Yes R26. I'm an old punk fan and a small one. When I went to see Bad Religion or the Vandals, I stayed far from the mosh pit. It was just known it was going to get rowdy, even if there were signs saying not to stage dive, and there were always signs saying not to stage dive. I didn't go to punk shows in high school though, my mom knew they were dangerous. Why did Bird's mom let him go, I wonder. But yeah, a true punk show will always be violent like this, it's kind of the point. I'm sure these fuckers are posers though, I just have a feeling.

Just like there are or were, signs at concerts stating that weed wasn't allowed, people always smoked at shows. They also had signs that crowd surfing wasn't allowed, or stage diving, and people still did it. I guarantee the venue knows this band does that shit, but they didn't care till now. Stage diving is basically what made a punk show a punk show, and not just some shitty alternative music. Henry Rollins, Jello Biafra, Mike Muir...they all did that shit, it was expected and people would be pissed if they didn't. It was an honor to get to have these guys jump into you and you got to feel them up if you wanted.

I think most of us appreciate that crowd surfing and stage diving are normal at some shows. The difference is the size of this particular singer and his apparent history of downplaying safety concerns.

This bullshit happened at a Tea Party concert I was at many years ago. It was a small venue in Toronto. I got scalped by a guy who was crowd surfing and got his belt buckle caught on my hair, which was long at the time. I started throwing punches and then left before I could be arrested. I hit many people that were innocent and got punched a few times myself. I just went blind rage apeshit. That's my crowd surfing experience.

Someone's comment from the band's subreddit (downvoted of course):
[quote]if there's an inherent risk of breaking someone's neck, you shouldn't do it. knowing that's an inherent risk and doing it anyways makes it your fault. people drive recklessly or drink and drive, that doesnt mean if they get into an accident we should defend drinking and driving or reckless drinking bc they didn't intend to do it. you don't get to drink and drive and hit someone and then blame them for being on the road at all knowing there's a risk of being hit.
A bit simplistic, but they have a point.
