I may never understand sentencing. A child pornographer can get five years or fifty years. A rapist can get three years or thirty years. One murderer gets twenty years, the next one gets life without parole.

It all seems so scattershot.

So, the jury found he raped 2 women. Each charge (one for each woman) would have subjected him to 15 years (sounds like).

If run concurrently (at the same time), that would make it 15 years.

Consecutive (15 years, then 15 more) would make it the 30 that we have here.

Not sure how a life sentence was a possible outcome. CA must have a law that attaches life sentences to sexual assaults.

R30, the testimony does suggest that the women were drugged—he gave them a drink and they became woozy.

Sentencing is all over the place because different states have different rules about sentencing. In addition, you can usually get a shorter sentence by agreeing to plead guilty. Going to trial is a huge gamble.

He got the sentence violent rapists SHOULD get. Instead of saying it was too harsh, we should be expecting at least the same for murderers. It's the judges who give lenient sentences who are in the wrong, not this one who gave a fair sentence.

Someone who rapes while beating and smothering somebody or holding a gun to their head deserves what he got, at minimum.

Yes, it's normal for a defendant in a criminal case to not testify.

If you were accused of murdering someone and you claimed self-defense, then yes, it would be normal to testify.

One of his defense attorneys, Shawn Holley, said:

Taking the stand for the first time Oct. 24, Masterson accuser Christina B (aka Jane Doe 3) testified that she and the actor had been going out for more than four years, starting in 1997, when she woke up on one occasion in 2001 at his Hollywood Hills home (where she lived at the time) to find him having sex with her.

"I told him I didn't want to have sex, and he wouldn't stop," she said. He pinned her arms, she continued, making her feel "trapped...I was screaming at him to get off of me."

When she pulled on his hair, which was against a rule he had against touching his face or hair, he struck her on the left side of her face, the witness said, then spit on her and called her "white trash" as he got up.

About a year into their ultimately six-year relationship, Christina said, "He became very aggressive sexually...I remember coming back from Paris [in 1998] and I was really really tired and jet-lagged and sick and he wanted to have sex and I didn't. And it resulted in a fight where he dragged me by my hair along the floor. He called me fat and other insults. That's the first that I remember."

Whether she wanted to have sex when he did or not, she continued, "most of the time I let it happen. It would get to the point where if I made it an issue, he would ignore me for a day or two where I would go groveling to him."

And if she didn't apologize to him, she said, "there would be no communication."

I figured if I shared this on any other thread, I'd be dragged and told that I liked it.

I ended up moving to another part of the campus to get away from all the drama because word had gotten around. I can'tt imagine what i would be like in today's social media world. I would have killed myself.

I learned a great deal about people's tendency to judge and make fun of victims. It made it impossible to make friends. Fortunately, I was able to make one good friend when I moved to another part of the university.

Sometimes when the college reaches out asking for donations I feel like writing back to them as to what happened to me. But I don't think they'd care.

But I'm alive. I'm okay. I don't think I've ever really learned to trust.

As an aside....I can't help but feel a little sorry for everyone else associated with That '70s Show. Not necessarily Ashton Kutcher, Wilder Valderamma or Laura Prepon -- they were all good buddies/close with Masterson. (while he was with Chrissie Bixler)

But everyone else: Topher Grace (who had the good sense to separate himself/was always on the outside of their little clique), Debra Jo Rupp, Kurtwood Smith, Don Stark....as well as the hundred or so other behind-the-camera crew members who worked on it.

Maybe after 15 years, there will be some kind of reassessment. But, other than appeals working, I don't see how he avoids the 30.

I suggest those defending him look up the details. It's disturbing. He thought he was above the law and treating these women as human beings. I bet no one here would be upset if he was out there gay bashing or commiting other hate crimes. Sexual violence at that level should be considered such. I wouldn't doubt it if he's VIOLENTLY raped other women this way but it wasn't reported or he did it out of the country. These types leave trails of victims. Honestly, I’d like to hear someone who has been raped and who has also spent years in prison come forward and compare the two. I think such a person would be the best person to judge how many years in prison is proportional to the crime of rape.

However, these rapes happened 20 years ago, and circumstances have changed since then — he’s older, less likely to offend again, and he has a daughter who will grow,up,without a father (although it can be argued she’s better off without him).. I don’t think he should get off scot free, but I’m skeptical that 30 years serves any purpose at this point. There are other remedies. There is such thing as a Goldilocks punishment (too lenient, too severe, just right).

For the record, Rodney Reed is not an innocent black man sitting in prison for raping and killing Stacy Stites. And Bill Cosby got out of prison.

Let’s hypothetically propose that my mother’s current husband hasn’t beaten her in 20 years… what exactly does that do?

My mom is a complete shell of a human being now. Every time she ended up or ends up hospitalized, I wonder if the reason given for the hospitalization is/was truthful.

This man runs around acting like the most WONDERFUL person, and guess what? He IS WONDERFUL to MANY people, as long as they don’t live with him, and oppose him regarding anything, whatsoever, behind closed doors.

Masterson profoundly hurt others, R293. I am able to objectively understand your POV, however, he absolutely, truly hurt these women & possibly more, & he deserves his sentence, even if indicted/charged/sentenced 20 plus years later.

He treated these women like garbage, R293. He had ZERO regard for their comfort, health, safety, mental health, physical well being, their personhood, or even their lives and the PTSD one grapples with when victimized by someone like himself.

He didn’t give one flying fuck about his victims, R293. He really, really didn’t, which is why I find his sentence fair, as I have no doubt that at one time, he actually believed he’d gotten away with his crimes.

If I were Ashton and Mila I would tell everyone whinging about the letters (including R327) to go fuck themselves. They wrote a letter attesting to what they know about their friend. Letters that made no difference. Outrage culture is tiresome. Danny is a criminal, and he got the sentence he deserved. All Ashton and Milla did was write letters. It isn't like they held the women down while Danny raped them.

Mila Kunis and Ashton Kutcher showed INCREDIBLY poor judgement, at best, writing those letters. It’s not like Masterson was being tried over a misdemeanour traffic violation or something. These weren’t “mistakes” or indiscretions of youth. The kind of violence he perpetrated against these women puts him in the very twisted criminal category. And obviously the victims were found to be credible in a court of law.

I think this will haunt them for a long time. And rightly so.

Murderers literally get less time.

No toxicology evidenced was produced - so we can't say that he drugged them for certain.

3 of the 4 accusers were Scientologists. Not exactly trustworthy people in a court of law.

I've heard of these accusations for years - a decade or more? I just don't see how they were able to conclusively prove this? I'm not defending him - I'm just wondering what other evidence they had?

So I read the 3 testimonies. One woman was at a club all night and went back to his house with some friends - at which time she had her one and only drink for the night.

Another one said she was over at his place with 20-30 other people and she had a drink in the hot tub and she got woozy and threw up and that he ended up putting her in a shower and washing her breasts. Ummm - to get the VOMIT off?

The only evidence they had was their testimonies - no physical or toxicology evidence. And all 3 met and spoke with each other before pressing charges.

One of the accusers was an ex-girlfriend.

This doesn't sound so airtight to me. And to give him 30 years?

Yep, R350. I think it was an E: True Hollywood Story about T7S...in which someone said Topher was aloof & kind of removed from the rest of the (younger) cast. All because he didn't hang out with them "off the clock", going to clubs & parties -- which made him *sound* like he was a jerk/ass/difficult (at the time).

Which he wasn't. He just did his "work" and went home.

All this bullshit about being Danny anti-drugs/the cast not being into drugs.....

Whether or not they partook of (hard) drugs ...they liked to drink plenty! On Friday nights, after the audience-tapings, the booze flowed freely on the Radford lot. They had poker parties in their dressing rooms, and then spilled out (in their cars) onto the streets of Studio City at 2-3 am. Meanwhile, Topher was outta there within a half-hour of the final "cut!"

R357 Well maybe my statement was a little hyperbolic… Look, it’s obvious that all murder is wrong, just like all rape is wrong. But there are degrees of severity in both crimes. Not all murders are violent. Certainly not all of them are premeditated. And some deaths come about as a result of someone flying into a rage and hitting someone and that person dies. More tragic than ghastly. And yes I’m aware that these cases could count more as manslaughter. But still.

When I read the victims statements I truly felt sick to my stomach. I thought only someone seething with hatred of women and a darkly violent soul could do this to another human being. Someone who gets off on the destruction of another person. The drugging. The yelling. The belittling. The choking. The punching. The dragging. The violent sodomizing.The forced confinement. The covering up. The intimidation. Vile and dark stuff.

Many of us are reacting emotionally to this case. 30 years is a stiff sentence. But think of all the rape cases, famous or otherwise, where the perp gets 1 year, or 2 years, or time off for good behaviour. Many of us feel that rape convictions should come with much harsher sentences than the precedents have dictated. I just can’t cry in my beer over Danny Masterson.

I read their statements - and they were, frankly, a little unbelievable. One victim is out clubbing all night completely sober comes back with SEVERAL people also there, has one drink FINALLY at his house, then wakes up to him having sex with her? She only had one drink the whole night - and only at his place?

The other woman was there with 20-30 other people with the whole vomiting thing. None of her friends went to check on her? Do you think it's something he would do would 20-30 other people in the house?

The 3rd woman was a former girlfriend and said he raped her when she came home from Paris and was tired and he wanted to have sex because he hadn't seen her in so long and she was too tired.

None of these stories - the majority by Scientologists - sound extremely believable. Particularly because all the victims spoke with each other before pressing charges.

Did no one else in his circle hear or see any bad behavior?

Where is all of this other stuff you talk about - the choking, punching, dragging, etc? Was that his former struggling actress girlfriend who waited YEARS to talk about it?

And yes - the length of time DOES matter in coming forward when supposedly it's so serious.

To send someone away for 30 years PURELY ON TESTIMONY is insane.

If you re-watch old interviews with Masterson, he definitely has a very dark, sinister energy.

When That Seventies Show was first popular, I vaguely remember thinking there was something very “off” about him. I’d normally be crazy for a cute, funny, sardonic character / actor but he was very off-putting.

It wouldn't be the first time the room was wrong, R394. So you're saying that Ashton and Mila knew Masterson was a violent rapist but they were incredibly stupid enough to stick up for him publicly anyways. They couldn't have just kept quiet. Just because someone has an odd, off-putting personality and doesn't come off well in interviews and makes jokes in poor taste that fall flat, doesn't make them a major criminal. They heard the allegations but did not want to believe them because they could not imagine him doing something like that.

In my jurisdiction, some of those support letters would be sealed (unavailable to the public). There's a pre-sentencing report that is written / compiled by a court employee - that report is sealed. If a defendant submits letters to the court employee who does the report, then the letters are sealed, along with the report.

The report (and any enclosed letters) are available to the judge, the prosecutor, and the defendant (but not the public).

I'm guessing Kunis / Ashton sent their letter directly to the judge, who then made it available to the public.

What Kutcher & Kunis fail to understand is that some seemingly good people can do horrible things in secret. That does not mean the good things they've done should clear the score when they do bad things.

I wonder if they would have written the same letters of support if they had personally witnessed Masterson raping women? I seriously doubt it. There is no scenario where someone's good deeds, no matter how magnanimous, can conceivably work in their favor when they've been convicted of such heinous crimes.

From all we know, it was just testimony. And in a lot of jurisdictions, that's all that is needed.

For those not in the courtroom, it seems like it's one person's account versus the other - which seems like a very dangerous and low bar to convict.

The stories provided by the victims just seem off - particularly the ex-girlfriend. 30 years for she said/he said.

R521: Extorted by other prisoners for protection -- although protection isn't even really the right word. For the privilege of not getting his ass beat on a daily basis, or killed. (they refer to it as "rent"). I saw an interesting interview with a former prisoner who explains how that all works, and the type of people Danny will be incarcerated with even in a "Special Needs Yard" (or "protective custody"). Obviously, there's no money transferred on the inside -- it takes place on the outside, between family members (called "street to street").

It's a very long interview, but I think the main gist of what I'm referring to is covered in the first 10-12 minutes.

Chynna (she, Bijou, & Mackenzie have same father, 3 different mothers) told a really sad story and even though she talks about Jesus way too much, I feel bad for her.

She went with brother Tamerlane (Bijou's full brother, I think) to visit Dad (Papa John Phillips who had sex w/his own daughter, Mackenzie). Michelle (mom) told Chynna be careful, blah blah blah. John ends up basically kidnapping Tamerlane and taking him to a foreign country.

Even though Michelle's not Tamerlane's mother, she had custody of him.

Anyway, that's a sad story and what a heavy burden for a child (Chynna) to bear: to be tasked with not letting John kidnap your brother.
