Ex-NY police chief who led Gilgo Beach murders probe arrested for soliciting sex at Long Island park

Former Suffolk County Police Chief James Burke, who officials say botched the more than a decade-long probe into the Gilgo Beach murders case on Long Island, was arrested Tuesday morning.

At a press conference, Suffolk Police Commissioner Rodney K. Harrison revealed that Burke, a convicted felon prosecuted in federal court for beating a handcuffed suspect and covering it up, was newly arrested on multiple sexual misconduct charges. After authorities had received "numerous complaints" about people soliciting sex at the Suffolk County Vietnam Veterans Memorial Park in Farmingville, New York, the Suffolk County Park Rangers' Targeted Response Unit conducted a sting operation.

Undercover rangers engaged one individual during the operation at 10:15 a.m. who "was soliciting for sexual engagement," Harrison said. "Due to the actions that I am not going to share, this individual was placed under arrest. The rangers ascertained that our perpetrator involved was identified as James Burke, former chief of the Suffolk County Police Department."

Burke, 58, of Smithtown, New York, was processed at the Sixth Precinct on charges of exposure of a person and public lewdness.

Additional charges were pending, Harrison said. Burke has since been released after being issued a desk appearance ticket to show in court on Sept. 11, Tania Lopez, a spokeswoman for Suffolk District Attorney Ray Tierney, told Fox News Digital.

Authorities said Burke attempted to leverage his status as a former law enforcement official to get out of the arrest.

"The ranger who made the arrest of Mr. Burke did not know he was [James Burke] … not at first, not until he identified himself and said who he was and said, ‘Do you know who I am?’" Stephen Laton, chief of the Suffolk County Park Rangers, said at the Tuesday press conference.

"He was expressing to us how this would be a public humiliation for him and such," Sgt. Brian Quattrini, also of the Suffolk County Park Rangers, added.

Burke, Suffolk County’s police chief from 2012 to 2015, led the department through a tumultuous three-year period that culminated in his arrest and guilty plea to federal charges for beating a handcuffed man suspected of stealing pornography, sex toys and other items from his department SUV.

The scandal also toppled the county's longtime district attorney and the county's top corruption prosecutor, who were convicted of helping Burke cover up the beating.

Burke resigned in late 2015, just before federal prosecutors charged him in the beating and cover-up that put him behind bars. He served 40 months in prison and was released in 2019. His probation ended last year. Burke’s lawyer in his previous case died last year, according to the Associated Press.

Former Suffolk County District Attorney Thomas Spota, 81, and the chief of Spota’s anti-corruption bureau, Christopher McPartland, 57, are both serving five-year prison sentences for witness tampering, obstruction of justice and conspiracy.

During his tenure, Burke oversaw the high-profile investigation into the deaths of multiple sex workers whose remains were found in the area of Gilgo Beach on a desolate stretch of Long Island coastline. Burke has been criticized over his handling of the investigation by other law enforcement officials, who said he blocked his department’s cooperation with the FBI.

Disgraced police chief James Burke was spotted leaving jail after he was arrested for allegedly offering oral sex to a male undercover park ranger.

Burke, 59, was detained at 10.15am Tuesday morning and charged with offering a sex act, public lewdness, indecent exposure and criminal solicitation.

The former top cop is accused of pulling down his pants and displaying his genitals, as well as manipulating them in a sexual manner. He then reportedly told the undercover ranger, ‘I like sucking d***.'

He begged Suffolk County law enforcement not to arrest him for soliciting sex from the ranger - before asking 'Do you know who I am?'

Burke was later seen leaving the Suffolk County Police Department's 6th Precinct in Selden, where he was processed and charged. He left without speaking to reporters.

The 59-year-old is widely blamed for mishandling the Gilgo Beach investigation after kicking FBI agents off the case, has further charges pending.

Authorities confirmed Burke was allegedly soliciting sex from a male undercover park ranger near the Suffolk County Vietnam Veterans Memorial Park when he was arrested on Tuesday morning.

He asked the ranger: 'Do you know who I am?', before telling officers the arrest would be a 'public humiliation' for him.

Burke, who was the highest-ranking uniformed officer in the county for four years, was arrested in December 2015 after beating a man accused of stealing a bag containing sex toys and pornography from the cop's car.

This week, county rangers set up a sting operation after a number of complaints about people soliciting sex in the area.

Officers said they had 'only been in the area for a few minutes' before the solicitation attempts from Burke began.

Suffolk County spokeswoman Marykate Guilfoyle said in a statement: 'At approximately 10:15 a.m. at Suffolk County Vietnam Veterans Memorial Park the Suffolk County Park Ranger's Targeted Response Unit (TRU) arrested James Burke.

'At this time, he is charged with offering a sex act, public lewdness, indecent exposure, and criminal solicitation, with additional potential charges pending.'

Sources told Newsday that Burke had a small amount of marijuana and a muscle relaxant on him when police arrested him. He has not been charged with any drug counts.

Burke is expected to be given a desk appearance ticket on September 11 for two misdemeanors and violation charges.

Public lewdness in the first degree is a class A misdemeanor, punishable by up to a year in jail and a $1,000 fine.

Exposure is a violation, with a maximum sentence of 15 days in jail in addition to fines and community service.

District Attorney Ray Tierney said his office had been waiting for the charging documents for the former officer.

Before Burke became Suffolk County's top cop, he had been involved in a series of scandals involving drugs and prostitutes.

An internal police investigation found Burke left at least one of the women in his patrol car alone with his service weapon resting on the back seat.

Burke was released from prison in November 2018 after serving a 46-month jail term for beating a heroin addict who had stolen a duffel bag from his vehicle.

Christopher Loeb, who was 26 at the time, was arrested in December 2012, suspected of stealing a the bag containing a gun belt, ammunition, sex toys and pornography from Burke's unmarked police SUV.

The vehicle had been parked outside of his home in St James, with Burke found guilty of beating Loeb inside the Fourth Precinct in Hauppauge.

Burke then orchestrated a failed cover-up when Loeb complained about the beating and the FBI investigated Burke and his cronies in Suffolk County.

the story is that he didn't allow the FBI in to investigate the murders because he was afraid they would find out that he was soliciting sex himself. He did it to cover his own ass. I used to live in Massapequa myself (thank God it wasn't for too long). Except for an excellent pork store, the town has nothing to recommend it. The cops were the usual types, no better or worse than anywhere else, although there were more of them living in Massapequa than most towns on Long Island.

no, I'm not a websleuth lady. Massapequa is in Nassau county and this cop was from Suffolk county even though the cops were about the same in both counties. I grew up in Levittown which is 10 minutes from Massapequa but then I moved to Shirley out in Suffolk. All the mafia used to go out to Shirley/Mastic Beach on weekends. I'm sure they were real friendly with the cops.
