Subsequent to the initial statement, a representative for Elfman claimed that Elfman and Abadi’s “limited interactions, which did not involve sexual contact, were fully consensual.” The representative also claimed that the initial settlement was a reaction to the #MeToo movement.

“When faced with threats from the other party to go public with untruths at the height of the #MeToo movement, [Elfman] faced the impossible choice between settling and continuing his career and earning a living for his family or deciding to fight what at the time was an unwinnable battle to tell the truth — Danny chose his family,” the representative says. “It is disappointing, but sadly not surprising, that this baseless narrative would be revived now that the payments have stopped. Accusations alone should not and do not equate to guilt, and Danny will defend himself and clear his name with the volume of evidence and the other party’s own words — her words speak for themselves.”

Through her lawyer, Abadi declined to comment for this article. In a statement, Abadi’s attorney Jeff Anderson said, “It is ironic that Mr. Elfman’s current statements are directly contrary to the position he maintained in the underlying dispute and to the evidentiary record.”

At a February press conference two days before this year’s Grammys, Abadi addressed the room as a survivor of sexual misconduct in the music industry and as an advocate on behalf of the Female Composer Safety League (FCSL), a nonprofit group she founded in 2020 whose mission is to “break stigmas in the industry surrounding trauma and shame.” While she didn’t name Elfman in her speech, Abadi, a Recording Academy member, stated that she didn’t vote after she saw the list of Grammy nominees, which she said included abusers. From the looks of the settlement structure, it was approximately $900k and change over five years. Elfman made regular payments other than two that were intended to be paid directly to her Struggling Female Musicians fund or whatever the fuck that is.

Those two payments - one due ages ago and one due now - Elfman simply refuses to pay. I believe the total of those two payments is $80-somthing thousand dollars. It is weird that there was so long between the two missed payments. Apparently the victim did report it, or her lawyers were aware of it, but did not take him to court over the first missed payment five years ago. I believe that they did send Elfman a notice (and his attorneys) that the payment had not been made at that time.

Personally, I think she should have allowed Elfman to pay those two payments to her and then she could have paid them to her foundation. I presume that the building the requirement into the settlement agreement was a way of ensuring that Elfman himself took responsibility and participated directly in helping other female musicians who were being victimized.

As a result of his recalcitrance, the NDA has been invalidated and blown. The victim's lawyers would have warned him about that when they demanded that he complete the terms of the agreement. I don't know the percentages. I know that the victim has spent quite a bit of her own settlement money on her foundation.

Elfman agreed to make two payments directly to the foundation. $45k five years ago and $45k now is what he was supposed to directly pay the foundation himself. That's what he signed, that's what he agreed to. If there was some problem he had with it, back then was the time to speak up. Signing a legally binding agreement with a payment schedule up front and then bizarrely reneging on the terms of that agreement is really stupid.

Elfman is not only still liable for the $90k he owes, there will probably be additional sanctions against him for blowing off this settlement agreement. You can't just do that and expect to get away with it unless you are insane. If he had/has some sort reasonable objection to paying the foundation directly, he should release a statement letting everyone know what that was, exactly, and why he did not resolve it prior to signing this agreement five years ago. How do NDA payments usually work?

They don't usually happen, R418. These are two very separate things, normally they are separate.

There are NDA's, contracts signed not to reveal so-and-so's secrets or habits or what they said and blahblahblah. People working in a celebrity's house would sign one of these as a matter of course and condition of employment.

Then there are NDAs related specifically to sexual misconduct on someone's part. That is not a condition of employment, it's generally after employment has and acrimonious end. There may be a payment involved in that situation. It could be a lump sum or paid out over time. Depends on the terms of the NDA agreement.

There may be many other kinds of NDAs people enter into, with and without any payment being involved. These seem like the ones that were/are involved in this Elfman thing.
