Christine Costner’s Wild Declaration Of Divorce Released

Kevin Costner's estranged wife agrees her lifestyle is "extraordinary," and she isn't about to give up on that so quickly. Let the court docs reflect that.

Christine is ensuring that Kevin continues to allow her and the kids to live in luxury, and her 8-page declaration reflects just that. So far, Christine has chosen to sit pretty in the $145 million compound she and her kids have lived in for over a decade.

In her declaration, she makes it clear she isn't leaving until she gets what she wants and needs from the dissolution of this marriage. "I realize that our lifestyle is extraordinary," she states. She is hoping the declaration will help to make the prenup invalid.

Another primary reason she is fighting the ironclad prenup is that it states that in addition to not receiving spousal support. She will only get $38,000 in child support from the actor, worth millions.

The declaration continues to call out the struggle she will be in if she allows this prenup to be used. "If I were to recreate our lifestyle today, the costs would be much higher given the increase in the real estate market."

She wants a Santa Barbara County judge to increase child support to nearly $250k monthly. She also stressed that she is a full-time mom and housewife, noting that she cooks and cleans for three teenagers, 13, 14, and 16.

She drives them around to all of their extracurricular activities and school. But admits she has extra help.

"Our children's lifestyle has been supported by a house manager who supports and assists with the logistics of the children's activities, b. A person who assists with grocery shopping and meal preparation; and c. A housekeeper who assists with cleaning and laundry."

The soon-to-be single mom is doing this to secure her kid's future. "My primary goal is to make sure that our children continue to thrive and, when they are with me, to live in a home and lifestyle at least somewhat comparable to that of their father."

On the other hand, Kevin sees it as a tactic she is playing and attempting to his home like a carrot dangling in his face. She admits that her income is null and will need Kevin's assistance even though she is the one who called it quits on the 18-year marriage.

"Kevin is trying to force my concession that the spousal support limitation is valid by my "acceptance" of these funds," Christine claims in the docs. "Kevin's goal is to get me to tap into this money, so he can argue that I've waived my right to challenge the Premarital Agreement."

The handbag designer also shared that she was duped into marrying the actor only to find out it wasn't what he led her to be. She described him as "handsome" and "charming."

She claims, "Kevin worked throughout our marriage, often traveling for various on-location projects and events. He has been very successful and has had a rigorous travel schedule. He's often on location for approximately four months throughout the year."

She was sick of being lonely and was ready to move on with the help of Kevin's money, of course!

R3 My friend lives in a house in a nice village in Westchester (3 children) and she is in the midst of a divorce. I helped her find an attorney and I do most of the calls with her. It has been a real eye-opener for me in terms of the process and strategy.

My friend's house is in disrepair. I have helped her determine what their monthly budget had been. It can seem astronomical because the annual land/school taxes alone are almost $40K and then the annual mortgage is higher. $7,000 a month before you even get into all the other things. Totals more than $20K a month so yes, whatever is going on with the current Mrs. Costner, $38,000 for child support is absurd. He just has a great lawyer who is starting out at an extreme. Hopefully she does, too.

Meanwhile, isn't Costner a billionaire? I thought Dances with Wolves made him rich beyond normal actor/producer bounds.

R41 $38,000 a month for the child support for three minors (three rich kids) is ludicrously low. Usually tuition is not in that child support number (and is separate) so let's assume it is not:

-Private Security

-Meals

-Clothing

-Local Transportation

-Medical Expenses

-Dental Expenses

-Extracurricular Activities (Sports team expenses, music lessons, dance, etc.)

-Travel

-Tutors, Coaches

-Incidentals / Toiletries / Entertainment

I'm not even trying hard with this list and it ads up to about $275,000 a month for three kids

If tuition needs to be added, that would mean about another $225,000 + a year for three high school kids...so about $295,000 a month.

Child support is NOT for the spouse, but for the children.

He's divorcing the wife, not the kids. In ALL divorces, where there is no paternity fraud, both spouses are responsible for paying to maintain the standard of living as close to what the children had during the marriage.

$38,000 per month is pretty easy to live on if you don’t have a house manager, housekeeper, and personal shopper/cook on salary. Other than spending time with the kids, I’m not sure what being a “full time housewife and mom” constitutes in this scenario.

What I will say that’s critical of Kevin here, though, is that this is why you should not continue to trade in for younger wives and have more kids again and again. This is his third baby mother. His oldest kid is 39. There is no reason he should still have kids who are minors at his big age.

Kevin Costner and Christine Baumgartner had a prenuptial agreement in place prior to the recent divorce filing.

The actor's wife filed for divorce on Monday after 18 years of marriage, citing irreconcilable differences as the reason for the breakup, according to documents obtained by PEOPLE.

In her filing, Baumgartner, 49, listed their date of separation as April 11, and she requested joint custody of their three children: Cayden, 16 on Saturday, Hayes, 14, and Grace, 13 next month.

Costner, in his response filed Tuesday, also asked for joint custody and cited irreconcilable differences. The actor/director's filing also mentions a prenup, in regards to spousal support, legal fees and properties.

A source tells PEOPLE that divorce wasn't Costner's idea: "It was not anything that he wanted or sought, and if he could change the situation, he would."

The "separate property" his legal team listed include: "Miscellaneous jewelry and other personal effects; earnings and accumulations of Respondent before marriage, during marriage, and from and after the date of separation; [and] there are additional separate property assets and obligations of each party as mandated by the parties' Premarital Agreement."

They also add, "Pursuant to the terms in Paragraph 9.A. of the parties' Premarital Agreement, Petitioner to vacate Respondent's separate property residences."

Costner was previously married to Cindy Silva for 16 years before their divorce in 1994 — which reportedly resulted in an estimated $80 million settlement to his ex-wife.

The pair got married on Sept. 25, 2004. In a statement Tuesday, Costner's rep said, "It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr. Costner having to participate in a dissolution of marriage action. We ask that his, Christine's, and their children's privacy be respected as they navigate this difficult time."

In November, Costner told PEOPLE about raising a family with Baumgartner. He said at the time, "The house is prettier because of her. Everything is warmer because of her. There's these little things that she does — and I think it's the power of love — but that she makes her home that way."

The actor added of what he learned from fatherhood, "The world doesn't revolve around you. It just doesn't revolve around you. I work as a provider. I'm a father and I'm a husband, but it doesn't revolve around me."

I can't help but feel sorry for the teenagers (regardless of how privileged they are, or what they've been accustomed to). No matter what a court decides about child-support, they'll be damaged by this nasty, public-fighting. My parents weren't public figures, but the fighting during their separation & divorce (which coincided with my teen years) absolutely took an emotional toll....because they constantly talked shit about each other, and tried to turn me against the other & choose "sides". I can't imagine how awful it would have been if one of them had been a very famous public figure.

My sister married a himbo. When they separated, she moved out and left all the furniture and furnishings (which she had paid for.)

She did this because she didn’t want their child to notice a difference in lifestyle when visiting daddy on the weekends. She knew her husband— even if he had the money—would have no idea how to go about buying furniture and they’d end up eating on the floor or something.

I don’t see why Kevin can’t bend a little to keep the kids in a stable environment. Kids are cynical these days, but they would be traumatized by leaving their home abruptly.

A couple of points I didn't see mentioned above:

1. The kids are of an age where they can decide with which parent they want to live. Joint custody, if granted, does not mean 50-50 time. If the kids live with Costner, they will maintain their lifestyle, and the overwhelming majority of their expenses will have been covered by dad. When they are with mom, $450,000 a year will definitely provide a roof to go with the bread and water.

2. The $38,000 per month for child support could be on a per-child basis. That would mean the ex gets about $1.3 million a year for the next few years. Add that to what he already gave her to find new housing, and she might, just might, be able to find a small apartment somewhere far from the coast that she could afford.

Sorry if my points are slightly biased against the soon-to-be-ex-wife, but I have no patience with people who sign legal documents and then try to weasel out of them later.

Due to inflation and real estate prices rising so rapidly, much has changed since she signed that prenup. For instance, Kevin tried to sell this same place for 60 million only about 6 years ago, and it wouldn't sell because that price was too high at the time for the market. Now, the same market values that house at 145 million! This means the million she agreed to in the original contract is worth far, far less that it was when she signed. It is reasonable for her to seek adjustment due to this, and it would be reasonable for Kevin to accommodate within reason, especially considering how much he earned on his projects, investments, and increased equity during the marriage.

R151 prenups don’t adjust for inflation or relative net worth. He also doesn’t have the same income potential that he had 20 years ago, but that’s also irrelevant. She agreed to a specific dollar amount of spousal support and she agreed to vacate the house; she signed that contract. It doesn’t matter if he’s worth more or less than he was when they signed. That is the whole point of a prenup — she is not entitled to enhanced benefits based on assets he has acquired during the marriage.

One of the mistakes that people signing prenups make is not to get their own attorney to read and negotiate the contract before signing anything. Sorry, but I find this insulting. There are MILLIONS of teenagers who thrive without any problems in spite of the fact that their father isn't going to give them $38k PER MONTH in child support. That is almost half a million dollars per year, which is A LOT. The vast majority of families do not have that sort of money at their disposal and they do just fine. Contrary to what the nutjobs on this thread are alleging, it's Kevin Costner who is trying to save the marriage.

He wants to keep the marriage AND the family together, and he has nothing but good things to say about Christine. Not one bad word has been uttered by him about her.

But she is determined to be with this ... person ... who she's having sex with. I don't even know what he does for a living, but apparently now he flips houses to make money.

I think Daniel Starr has convinced Christine to divorce Kevin, and then he'll help her make her own money, by buying and selling real estate.

However, she has to get Costner to amend the pre-nup, so that she can get a larger share of his assets than what she had previously agreed to.

This grifter knew exactly what she was doing when she married Kevin. He didn't want any more kids (after his first marriage), but she said "if you want to marry me, then I NEED kids."

Why is that? Because kids = $$$$ for a woman married to a rich man. So Kevin agreed, and they got married and had kids. Who are all taken care of by nannies and a "house manager."

And now that she has found some good dick, she thinks she's going to publicize the divorce to extort money from Kevin. Then run off and get together with this new guy.

A contract is a human made instrument, and, as such can be changed by humans.

This notion that a pre-nuptial contract is akin to Moses bringing the tablets down from Mt. Sinai, set in stone and sent by God, and therefore, can never be in breach, or changed, is just nonsense.

I don't imagine his request for joint custody means equal physical custody. Joint custody can mean physical, legal or both. I suspect it's joint legal so he can share in decision- making about medical, educational and other matters relating to upbringing. He's gone months of the year on location, tends to business affairs, and has multiple romantic affairs to juggle. The last thing he wants to do even with domestic help, is look after three teenage boys two weeks out of the month. He strikes me as the every other weekend type.

Lots of things might not exist at the time of a prenup. The prenup did envision children. I'm not saying it's 100% enforceable, here.

It is illegal (and unenforceable) to agree to child custody or child support in a prenup. That was not in the prenup, it's basic, any family lawyer (or most lawyers I would hope) know that. The only thing in the prenup is a statement that each owns what they own, and then some property settlement (the $1.2 million) to make it enforceable and then the terms- here is sounds like $38k a month for some period of time. Child support would be in addition to this, it cannot be contracted in a prenup ever, in every state.

I don’t find self-referential arguments persuasive either, but I choose to see the larger point offered - that financial, social, and privilege experiences vary.

Back to the topic- as others have pointed out, I don’t buy that Costner wants to be chintzy with his children. His beef is doling out to her and he knows the child support is her support.

Anybody who has endured a divorce, even a mutually desired amicable one, knows, in the midst of the worst of it, the emotional and mental cheese slips off the cracker.

Add millions of dollars to the recipe, a media war, and here we are watching and commenting.

I wouldn’t wish this situation on anybody, especially the kids.

Still, it’s pretty clear that with most divorces, when children are involved, both parties use the children to emotionally blackmail the other parent. If the kids had their way maybe they would prefer not to be with either parent.

I read an article that courts try to balance the living experiences, within reason, of children in joint custody situations so that they aren't living in a castle with dad, but in a three room shack with mom. While I am sure that $38K a month would be fine for those kids, it would provide significantly different lifestyles depending on which parent they were living with at the time.

The kids look fine. R246 you are correct, the goal is (within the bounds of means) to keep the lifestyle of the children as similar as possible so that there is not a downgrade if you will in living conditions. But, as I mentioned above that does not mean $175 million beachfront mansion. It means, they maybe live in the same town or near their school, and each will still have their own bedroom and in this case likely get to keep their nanny, get to go to the same camps and after school activities, get to go the same private schools, can afford the same wardrobe and have vacations with their mom. I do think she is trying to invalidate the prenup (which again has NOTHING TO DO WITH CHILD SUPPORT) and I think she is trying to invalidate it by putting out bullshit to make him look like a cheap father. I would guess he is going to give her more than the $1.2 million (maybe $10 million? total guess based on his high amount of wealth) BUT he is not going to want to pay her a monthly amount. No one wants to keep an ongoing obligation to an ex. So she can take the $38k a month if that is what the prenup says or go scratch. I am sure she would love a lifetime of monthly basic support checks coming in but that's not gonna happen. As for child support, I think he would end up paying somewhere between $50k to $100k, I think it would be $100k which would include any allowance for housing and that would end when the youngest is 21. He will also of course have to pay for college. SO that would be on the highest end $10million plus $1.2 million a year for the next 8 years for a total of about $20 million. This is what I think the negotiation is about. He is mad and wants her to bite it, she is delusional and thinks she is going to walk away with the $175 million house and $50 million.

Kevin Costner is accusing his estranged wife, Christine Baumgartner, of seeking nearly $250,000 in child support payments for her own benefit — not their kids’.

The “Yellowstone” star, 68, alleged in court documents, obtained by Page Six Thursday, that his forensic accountant found that the handbag designer, 49, spends more than $100,000 in cosmetic surgery procedures — and that’s the real reason she is asking for so much money.

They also claim Baumgartner has dropped thousands of dollars in boutique shopping, ATM withdrawals, construction loans, attorneys’ fees and other expenses that have “nothing” to do with her children.

Her attorneys did not immediately return Page Six’s request for comment on the allegations.

Baumgartner, who shares Cayden Wyatt, 16, Hayes Logan, 14, and Grace Avery, 13, with Costner, previously argued that the $248,000 a month she is requesting is “less than the amount needed to maintain the children in their accustomed lifestyle.”

However, the “Bodyguard” star said in the new court documents that he believes $51,940 a month, which is what he’s currently paying, is the “reasonable” amount.

Baumgartner filed for divorce in May after 18 years of marriage, citing “irreconcilable differences,” and the exes finances have been the biggest point of contention ever since.

Although Costner has a premarital agreement with his estranged wife that details how much spousal support she will get, she recently tried to push back on that, as well.

Baumgartner claimed in court documents obtained by Page Six last week that her movie star ex allegedly tried to deposit $1 million into her bank account to allegedly “force” her into conceding to the terms of her “limited” spousal support in their agreement.

“I cannot make this concession, do not accept payment, and instructed our financial accountant Francis Shelley to return the funds to Kevin,” she added at the time.

Baumgartner then revealed how much Costner made in 2022 in an effort to substantiate her claims, listing all of the “Let Him Go” star and their family’s lavish expenses.

The "Yellowstone" actor also claimed that he paid his estranged spouse $1 million for a new house, offering to pay the mortgage, insurance, and taxes for a year, per court documents.

Baumgartner accused Costner of trying to move her and the children out of the house before a child support order was in place, which he has denied.

"Kevin wants me to rent a place without a financial plan in place," Baumgartner said in the June 28 declaration. "However, I have our three children to think about. It is contrary to their best interests to commit to a rental that I may not be able to afford, particularly as that would ultimately lead to multiple relocations."

Lawyers for Baumgartner and Costner did not respond to Insider's request for comment.

Adding, “For your client to now be in breach of the document upon which Mr. Costner relied in entering into the marriage is disheartening.”

Saying that divorce is “not something Mr. Costner desires” is interesting language, considering the actor has been accused of letting their three children – Cayden, 16, Hayes, 14, and Grace, 13 – know that he and his estranged wife were getting a divorce via a ten-minute zoom call, at least according to Christine.

In November 2022, Kevin had nothing but positive things to say about his wife in an interview with People magazine. "My wife does things that just completely... It just helps. The house is prettier because of her. Everything is warmer because of her,” he said at the time. “There's these little things that she does and I think it's the power of love, but that she makes her home that way."

However, less than a year later, Christine filed for divorce from the “Field of Dreams” actor. She listed April 11 as their date of separation and cited irreconcilable differences for the split.

In early May, an insider told the outlet that the actor did not want a divorce. "It was not anything that he wanted or sought, and if he could change the situation, he would," the source said at the time.

In the statement announcing their split, a rep for the "Dances With Wolves" actor wrote: "It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr. Costner having to participate in a dissolution of marriage action."

Under the terms of the couple’s prenup, it looks like Christine is entitled to a settlement of $1.4 million; however, she is also asking for “248,000 total for all three children” per month. In a court filing dated June 16, Christine says that the number “is less than the amount needed to maintain the children in their accustomed lifestyle.”

In addition to paying almost $250,000 per month, she is also asking that the actor pay their private school tuition in full, as well as provide for their healthcare and finance their recreational activities, such as hobbies and sports. She did not note any spousal support in her filing.

On Wednesday, Costner’s legal team pushed back against the figure, claiming that "Christine allocates 60% of expenses such as private trainer, unallocated credit-card expenses, and her plastic surgery to the minor children without any explanation or basis. The children do not use the services of private trainers, only Christine does."

His legal team also alleged that Christine had plastic surgery expenses that totaled $188,500 per month. They noted that it was not the minor children, but Christine, who was receiving these services. "Christine should know which credit-card expenses were for her and which were for the children, but not even a minimal effort is made to allocate them accurately," the filing read.

At this point, Christine says in the new court filing that she is willing to vacate the couple's massive beachfront property in Santa Barbara, but wants to establish the financial support..... first.

Costner said he then was forced to step in and limit her access to his credit cards after he discovered Baumgartner used them to pay $45,000 for a Los Angeles-based lawyer, on top of the $40,000 she'd spent on her Santa Barbara-based legal team. She also charged $10,000 for the services of a forensic accountant, and another $10,000 for a separate forensic accountant whose services she no longer plans to utilize, Costner alleged in his declaration.

"It was then that I made the decision that there needed to be some reasonable limitation on the use of the credit cards," Costner said in court papers. "My lawyer gave her lawyers written notice."

Lawyers for the former couple did not immediately respond to a request for comment.

Baumgartner, 49, a handbag designer who said in court papers that she is unemployed, filed for divorce from Costner in May, citing "irreconcilable differences."

The pair, who were married for nearly two decades and have three teenage children, are set to appear in a California court later this week, where a judge will rule on Costner's motion to enforce a provision of their prenuptial agreement forcing her to move out within 30 days in the event they divorced.

Baumgartner has said in court documents she would move out by the end of August – but only if the "Field of Dreams" star agrees to pay her $248,000 a month in order to maintain their children's lifestyle. Costner said Baumgartner's wife's demand was absurd, and accused her of padding the figure in order to maintain her own luxury lifestyle.

can anyone figure out how she could be spending $188k per month on "plastic surgery" which i am sure is code for all of her treatments, injections, fillers, and the expensive followup procedures for healing that can be a part of plastic surgery. Even if she had dermatologists who come to the house, that would be a $5-10k appointment. and she could do that monthly. Even if she was paying $1k per facial, $1k per haircut....$500 per training session. i dont see how one could get the number that high.

In order to set up a "suitable separate household," for them, she has requested $248,000 per month in child support, a number Costner has rejected as "inflated."

On May 2, a rep for Costner, 68, confirmed to PEOPLE that Baumgartner, 49, had filed for divorce after 18 years of marriage. She listed their date of separation as April 11 and cited “irreconcilable differences,” requesting joint custody of their three children.

Since then, the separated couple’s legal teams have traded sharply-worded legal filings, battling over many issues, including child support.

Under the terms of their prenuptial agreement, Baumgartner is entitled to just $1.4 million, a sum Costner claims he has paid.

In their new reply memorandum, Costner’s attorneys mentioned local real estate listings, providing evidence that there are homes nearby that the former handbag designer cannot claim are unaffordable.

“Christine can afford to move,” reads their reply. “She has at her disposal almost $1,500,000 in cash to find alternative housing. Multiple 4-bedroom, 4-bathroom lovely homes are presently available, located in close proximity to Kevin’s separate property residence… Kevin made multiple offers to assist her in relocating.”

A source close to Costner recently told PEOPLE, “This is all about Christine. Kevin has gone above and beyond in providing Christine the necessary means to find a suitable place for her to move."

In late June, court documents obtained by TMZ stated that Costner was willing to give Baumgartner $10,000 to cover moving expenses plus $30,000 per month toward a rental home.

In a declaration directly from Costner, the new reply memorandum confirms he paid Baumgartner those amounts plus the $1 million due under their prenuptial agreement.

“I offered her the full use of household staff to assist in making the move, and I offered to pay her now the additional $200,000 I owe her under the PMA in cash, rather than as a down-payment towards her purchase of a home... I also told her that I would continue to pay 100% of the children’s expenses since she filed for divorce, and I have done so.”

He added that “there are multiple very nice homes in the Santa Barbara area advertised for six-week and more rentals through Airbnb. She could have arranged for a month or two month or shorter term rental.”

Costner then detailed the effect this conflict has had on his upcoming screen project, Horizon: An American Saga, on which he serves as producer, director, writer and actor.

Attorneys for Baumgartner did not immediately respond to PEOPLE's requests for comment.

Costner further claimed that he canceled one of Baumgartner's credit cards because, throughout May and early June, she allegedly charged more than $100,000: “Christine began charging large sums on the credit cards payable to her divorce attorneys and forensic accountants. She gave me no advance warning each time she did so."

Costner and Baumgartner are due in court on July 5 for a case-management conference.

According to Zillow, the median rent in Santa Barbara is $6,200, with less than 300 available rentals. By comparison, the median rent in California is $2,900, per Zillow.

In previous filings, Baumgartner has said she has no assets other than $50,000 in her checking account. Baumgartner claimed that Costner made $19 million last year, and covered all of the families $6.6 million in expenses.

After Baumgartner filed for divorce last month, Costner filed a motion to evict her from their marital home, citing a clause in their prenuptial agreement which allegedly gave her 30 days to move out after divorce proceedings began.

The "Yellowstone" actor also claimed that he paid his estranged spouse $1 million for a new house, offering to pay the mortgage, insurance, and taxes for a year, per court documents.

Baumgartner accused Costner of trying to move her and the children out of the house before a child support order was in place, which he has denied.

"Kevin wants me to rent a place without a financial plan in place," Baumgartner said in a June 28 declaration. "However, I have our three children to think about. It is contrary to their best interests to commit to a rental that I may not be able to afford, particularly as that would ultimately lead to multiple relocations."

I sorta believe his relentless absences are at the root of this. Simple as that. He's a workaholic. She probably thought she could handle it. Maybe the thought he'd slow down as he got older. He was gone a lot for Yellowstone and then he has this Horizon Quadrilogy happening now. I read that he quit Yellowstone because he, was preparing for, and I quote, "a grueling 220-day schedule" for Horizon.

Raising three kids alone gets lonely. All the staff and credit cards in the world can't replace companionship.

Call me crazy, but Occam's Razor tells me that he was just gone too damn much. Too self-aborbed. Busy being a great "provider" - but that can also be an excuse not to slow down and spend time with the wife and kids.

I do believe they were once very much in love. He was happy to have wifey 2.0 and she was in thrall to her movie star husband and her new tax bracket. You never can imagine, years down the road, how much the shine wears off of the bloom. Life is drudgery at any pay grade, unless you have a truly sizzling marriage with really profoundly deep companionship. I'm thinking Suzanne Somers or Piers Brosnan and his wife Kiely. That level of mutual obsession and loyalty makes all the ups and downs of life recede. I have a feeling that Kevin is no Piers Brosnan.

At 48, Christine isn't even post-menopausal -- she's perimenopausal. She's right in the thick of it. Mid Life Reckoning. Your hormones are up and down and all over the place, and your biological clock is telling you "this is my last chance to feel desired by a man before my ovaries close the shutters and I become old and invisible." He may have taking the marriage and the arrangement for granted. She's getting older, she is craving some juice - some TLC, attention, companionship.

I remember when my single mother was going through the Change. She was not herself for a few years. Jumping in and out of relationships like a fish gasping on dry land, flailing around hoping it might get lucky and flop into a stable pail of water. (She eventually did.)

"Attorneys call these provisions 'in torrerem' because it is a clause to instill fear. They are incentivizing someone from challenging the agreement."

Continues Chinitz, "It's basically saying, 'If you're going to challenge the agreement as being invalid and unenforceable, then anything that you may have benefited by, I have a right to claw back.'"

Celebrity divorce attorney Randy Kessler, who has represented former Real Housewives of Atlanta star NeNe Leakes and rapper Cardi B., agrees it's standard. The lawyer, who likewise doesn't work with Kevin or Christine, calls the clauses "very common. I have seen people agree to much more onerous terms and conditions."

The legal team for Costner—who has already paid his wife the $1.5 million she is owed under the terms of their agreement, which both parties signed before tying the knot in 2004—quoted the prenuptial agreement in response to a request from Christine’s side that Kevin pay for her attorney fees.

His lawyers countered that it should be Christine, 49, who pays for Kevin’s fees since they claim she is challenging the prenup. "Should any party contest the validity of this Agreement, or claim it is invalid in whole or in part, that party shall be liable to the other party for all witness, attorney, accounting and appraisal fees and costs incurred by the party defending the validity of this Agreement in the event this Agreement or any contested portion of it is adjudicated to be valid and binding," the document states.

Christine's attorneys have made the case that "there has been no determination by this Court that the parties’ premarital agreement is enforceable."

Chinitz says Christine's legal argument is likely a nonstarter because "the agreement is presumed to be a valid agreement until such time as a court sets it aside."

According to Kevin, the Costners' premarital agreement also stipulates that Christine move out of the star’s Santa Barbara home within 30 days of filing for divorce. Christine filed a petition for dissolution of marriage on May 1, meaning the deadline has since passed by more than a month.

Thomas Anderle, a judge for the Superior Court of Santa Barbara County in California, ruled at a July 5 hearing that former handbag designer Christine (née Baumgartner) must vacate their sprawling compound, worth an estimated $145 million, by July 31.

Christine, who shares sons Cayden, 16, and Hayes, 14, and daughter Grace, 13 with Kevin, has said she was staying put until she had a child support agreement in place in order to set up a "suitable separate household." She requested $248,000 per month, an amount Kevin's side slammed as "inflated."

Chinitz says Judge Anderle's ruling should speak loudly to Christine's side. "He's signaling to the attorneys, 'I'm enforcing the agreement.'"

The court has set a trial date of November 27 to determine its validity. But even if Christine loses, Chinitz says she may only be on the hook for Kevin's legal fees, not the entire amount of her divorce settlement.

"Kevin can afford to lose $1 million fighting this; he could afford to even pay the support if he loses it," he said. "She has one chance to win. She doesn't make this kind of money. She doesn't have these level of assets."

Costner has proposed to pay roughly $52,000 per month. Her request was submitted following a forensic accountant's report showing Costner's actual gross cash flow for the 2022 calendar year as $24,518,887, or $2,043,241 per month.

"He can suffer that loss much easier, probably without even feeling it really at some level, but it would be devastating to her," Melcher said.

"So the magnitude of the risk is higher for her than him, even though they're fighting over the same amount of money, because he's always going to be rich. Doesn't matter how this turns out. I think that she may have overplayed her hand, that the time to settle would have been before she filed where she could have kept this quiet, which would have made him happy."

Melcher insisted Costner "shouldn't get carried away" either, because if the premarital agreement is dismissed on a spousal support provision in the court, Costner would be responsible for maintaining her marital standard of living, "which is an enormous amount of money."

Sophie Jacobi-Parisi, partner in the Matrimonial & Family Law Practice at Blank Rome, said a resolution between an estranged couple out of the courtroom is always an easier solution.

"A private settlement is always better, especially when so much of their split is already in the news," Jacobi-Parisi told Fox News Digital.

Christine argued that the "Yellowstone" actor was being disingenuous with his claim of "doing the most [he] can reasonably do to make a divorce as seamless as possible for our children" as his actions showed "precisely the opposite" when he "sought to evict his wife and children from their home, and he now offers to pay child support of $51,940 per month."

"I would think that she will continue to seek the amount of support she feels is necessary to support herself and the kids, particularly now that she has to move out of the marital house, per the prenuptial agreement," Jacobi-Parisi said.

Costner has denied the allegation that he is "kicking" their children out, noting the kids will be in the home "during the time they are in my custody."

The "Dances With Wolves" star and Baumgartner both filed for joint custody of their three children: Cayden, 16, Hayes, 14, and Grace, 13.

Baumgartner submitted a forensic accountant's report last week that showed Costner's actual gross cash flow for the 2022 calendar year as $24,518,887, or $2,043,241 per month.

She said his $51,940 proposal was "inappropriate" for a number of reasons, that the amount was only "24% of guideline" and equivalent to 2.4% of his 2022 cash flow available for support.

What's so lame about this fight is the fact that child support in California is determined by a formula based on the parent's income. That's it. Kevin's income is entered into a computer as is Catherine's. If one of the parents doesn't have an income the courts actually GIVE them one, typically based on a full time minimum wage amount. Being a stay at home parent does not count as work.

Kevin's absurdly low child support 'offer' was meaningless--the courts decide child support, not the parents. He made himself look like a heartless miser to no purpose.

Costner gets his ugly house back but like I've said from the beginning, he's going to have to cough up considerably more than was in that pre-nup to support his ex-wife and three minor children.

Yes, they get to "use" his house in Carpinteria during his custody times (and what a fucking asshole Costner was to say that to the court and to his children) but with his overwhelming work and travel schedule, how often will that even be? His ex-wife has always raised their children and any judge is going to see that she continues to do so.

Her easily beating Costner in court over the child support payment amount is very good for her and for their children. Obviously she jacked up her initial numbers but it looks as if the judge worked it out properly. I'm sure that Mrs Costner is pleased with this monthly support order. "(Christine) bought an expensive vehicle for her personal use (probably because the PMA allows her to take that vehicle with her). Thus, it appears that she had been planning her exit long before she told (Kevin) in April 2023," the filing says.

In the end, Kevin calls his ex-wife's behavior "disturbing" saying, she "has shown a disturbing propensity in the last several months, both before and after separation, to take his property without his knowledge or consent."

It's about a twenty year marriage where she was responsible for staying home and raising the children. It's about living their lives in a manner that doesn't dump Mommy in a cheap condo while Daddy lives in an ugly beach house compound. It's about adjusting the child support to actually be able to support the children and his ex-wife in a way that will not cause embarrassment and shame for their children.

A well-supported life for a parent with three children in private school, living in a good neighborhood in a nice house with adequate staff and all the usual accoutrement is fucking expensive around here.

Kev wanted to kick the wife and their three children out of his house. He wanted to pay the measly amounts listed in a 20 year old prenup from when they had no children. He wanted (and still wants) to pay $1.5 million for a house here, which covers a semi-nice, small condo. He wanted to add 30k or 50k to that per month, realizing that the actual prenup was garbage at this point.

Mrs Costner and the three minor children need more than $1.5 mil for a proper house. The child support and the rest of the settlement can be worked out but for three kids with the lifestyle they've always known, Kevin's going to have to pay out a decent settlement and that includes at least several million for a house. The way he's trying to nickel and dime his ex-wife and kids to death (filing a complaint about a few pots and pans and dishes for his kids to eat on?) is making Kevin look more and more like a mean-spirited, cheap asshole.

He's never been well-liked locally but that's no big deal. He minds his own business and makes no fuss. Lots of Hollywood people keep a place up here to get away from LA for breaks. It's quiet. The weather's gorgeous. No one gives a crap about them and people leave them alone. We don't have paparazzi here unless they are called in by someone on purpose to stage some shots. It's a nice, calm, beautiful area and we like to keep it that way.

Costner is now creating a problem for himself. You can be a lot of things in Santa Barbara, Montecito, Carpinteria, etc., but being a cheap prick trying to use his kids to hurt his ex-wife isn't among them. Pay the money, do it quietly, don't expose the children to harmful publicity, be cool. Costner is failing and there is a lot of talk about it. People don't like the way he's treating his kids regardless of the situation between Kevin and Christine. People don't want to see this played out in the tabloid headlines every damn day - that's not how we roll up here. Save that shit for Hollywood, hold your temper together and pretend you're a quiet, sensible adult when you're in Santa Barbara.

The pre-nup did not say the she and the kids had to leave the house. It specifically said Christine had to vacate the marital home within 30 days of filing for divorce. Kevin is asking what was legally agreed to in that document.

Christine should have re-read the pre-nup before she filed. Also, she should have revisited the pre-nup as each child was born. That would have taken care of the low amount she would have received when she left. Take a note from Melania and/or Marcia from Succession. Marcia agreed to return to Logan with some renegotiated financial considerations.

In legal papers arguing for even more child support, Christine said the Colorado estate — which boasts three homes, two lakes and is bordered by a national forest that can't be developed — is worth $250 million. In Kevin's response, he said the houses are actually used as rental properties. (For $36,000 a night.) That mini-home is really small. The news article says that it sits on a "vacant lot" owned by Kevin, but that vacant lot is right next to the sprawling mansion Christine just moved out of.

When I first saw the mini-home, I thought it was probably built as a children's clubhouse or a temporary residence for someone who's doing work on the house.

I think she's just trying to stay in the vicinity. That's really weird that she ended up in that mini-home. I wonder what's in all of those shipping containers that surround the mini-home. Were the containers already there? Or is that all her stuff that can't fit into the mini-home?

The judge has not already found in Kevin's favor and has not found all the terms and conditions of the prenup valid now. Look at what the judge ordered Kevin to pay Christine per month. That's a lot more than was in that old prenup.

She'll get a decent settlement that includes a respectable property in a good neighborhood near Costner's house on the beach. We're not savages in Santa Barbara County. This isn't OJ Simpson-land where he takes the huge mansion and the wife moves into a little condo with the children. She was married to Costner for 18 years, had three children with him, stayed home and raised them. I don't know how much money Costner's made over the last 18 years but California is a community property state. When my parents divorced (Dad left Mom and us kids), his lawyer argued that Mom could get a job and only received alimony for 2 years. Christine can work so I don't see where she needs to receive $30 million. The kids are all in school now and will start college soon. Time to dust off that BeDazzler and start cranking out shitty-looking handbags, Chris!

No, Mom was a housewife and raised us kids. She didn't get a part-time job until I (the last child) was in school full-time. Dad and Mom got pregnant just before Mom graduated HS so she didn't to to college until after the divorce. I honestly don't remember if my Mom had an attorney but I assume she did. She never thought Dad would be so heartless and allow his attorney to do that and then agree to it. Child support was $250/month/per child in the 70s (my sister and I) until we were 18 and then he had to pay for college. My sister was 11 and I was 9 when Dad left.

I don't think it's about the spouse, it's about the children. The kids live a certain kind of life and they live their lives that way whether they are staying with Mom or Dad after a divorce. You don't make the children live in a cramped two bedroom condo with dad and a gigantic mansion with mom or vice versa. The lives of the kids stay on an even keel, regardless of which parent they are with.

He has seven children that we know of. Three are in their 30's with his first wife, there's a kid in his 20's from some random girlfriend and these three with Christine. These three children are 12, 14 and 15. Nobody's going away to college for years.

I think Clarkson's payments were steep but the difference is she wants the kids and her ex knew that, lived in "Montana" on the ranch and could have fought her and had the kids living there, particularly b/c she works so much and he doesn't. I think when you add up what she ended up paying him it was 10 to 15 million which is way more than the pre nup permitted. But she was very smart to just pay him off with a fixed amount- which will hurt but she can afford- to have him go away. He will not bother her or the kids now.

Costner noted that they were looking for a “very basic discovery” in regard to the “facts, documents and witnesses supporting her contentions” of their divorce battle.

Costner claimed that Baumgartner "steadfastly refused” to reveal her divorce contentions and has alleged that she “cannot admit or deny that she understood” their executed prenup. (She has not yet addressed his recent claims.)

“Christine asserts she cannot admit or deny that she understood the Premarital Agreement because she (and apparently all of her attorneys) do not understand the word ‘understood.’ This is gamesmanship of the worst sort,” the new docs read. “‘Understood’ is not a technical or arcane word. It is not ground for objection that a request is ambiguous, unless it is so ambiguous that the responding party cannot in good faith frame an intelligent reply.

The notion that Christine and the multiple seasoned lawyers representing her do not understand the word ‘understood’ and cannot reply to this simple, straightforward [request for admission] is frivolous. Clearly, this vagueness objection was interposed only for the purpose of delay.”

Us confirmed in May that Baumgartner filed for divorce from Costner after 19 years of marriage, citing “irreconcilable differences” as the cause of their split. The twosome have since been involved in a messy legal battle over finances, residency of their family home and child support. Costner and Baumgartner share three kids: Cayden, 16, Hayes, 14, and Grace, 13. (Costner is also the father of daughters Annie, 39, and Lily, 36, and son Joe, 35, with ex-wife Cindy Silva, and son Liam, 26, with Bridget Rooney.)

Baumgartner alleged one month later in June that Costner was attempting to kick her out of their shared residence and that she needed substantial child support payments to cover their children’s living expenses. Costner, however, claimed that he couldn’t afford her specific child support request because he “will earn substantially less in 2023” after Yellowstone’s fifth and final season wraps. Costner also alleged that most of Baumgartner’s expenses are used for her personal benefit rather than the kids’ necessities.

A judge later ruled that Costner must pay Baumgartner $129,755 per month in child support and ordered her to vacate his residence by the end of July.

Amid all the heated back and forth, Costner also asked the court to seal their upcoming divorce depositions, according to documents filed on Monday, August 7.

“Kevin is a public figure. The press and media recently encamped outside of his home, making ingress and egress difficult, if not impossible,” his attorneys wrote in the docs, which Us obtained. “If the date and location of the depositions of the parties is made public, the safety of the parties and counsel will be at risk. Ingress to and egress from the building in which the depositions will occur will become extremely difficult, to the point where law enforcement will likely be needed to clear streets, walkways and insure public safety. The order requested may obviate that need and protect the parties and counsel.”

Kevin already lost this war, it's simply a matter of how much it's going to cost him. Estimates vary but most put it at about $30 million. That seems low but I'm sure that Christine Costner and their children will be fine with that.

With an estimated $400 million fortune, Kev can easily afford it. He'd be getting out cheap at $30 million for a 20 year marriage with three minor children still living with Christine. Didn't Kev make $20 million for last year alone? He'll be fine.

Did your sacred (and already broken) prenup call for Kevity-kev-kev to pay Christine $129,000 a month? No it did not but that's what he has to pay her every month anyway. Look kid, he's lucky he doesn't have to pay her half of every dime he's earned over the past 18 years. If he walks away only $30 million poorer, he should be doing the happy dance.
