I Think I'm About To Be Evicted From My Apartment

How difficult is it to get another apartment with an eviction on my record? Am I permanently screwed?

Sorry to hear you lost your job. If possible, you should leave when they ask you to and don't fight it. Hopefully they ask for you to leave before involving the courts. I used to rent a house and asked the person to leave, who wasn't paying rent, and he wouldn't so I had no choice but to evict him. Which sucked for me since it costs money. And go talk to your landlord about it. Work out a payment arrangement? Just don't sit there waiting for the courts to come to your door.

Though regardless, there are people who will rent to you in the future

R3 lol. I'm looking to stay with friends temporarily but they wont permanently house me. I'm looking into hotels. Also I had a lot of wild parties this past year and there may be some damage to the apartment. I know I've done some dumb shit. R6 I'm optimistic, but I hope she doesn't evict me. My lease expires at the end of the month so it would be tragic to be evicted my very last month. R7 thanks for the advice. My landlord has been patient but she wants her money and I don’t blame her.

OP/R18- Damage to the apartment will make a landlord much less forgiving. If your friends are in a position to loan you the money, or split it with you, invest $120 in renting a carpet cleaner and buying a simple white or neutral wall paint, roller and spackle. It should be approximately $50 for the carpet cleaner and cleaning solution, and $70 for a couple gallons of paint, and basic supplies. If you return it to her in a condition that a suitable to rent again immediately, which will save her time and money, she may forgive the debt.

Thank you R13 and R14. I made a lot of dumb decisions this past year like allowing some couch surfing friends crash at my place at times. Of course they made a mess and then disappeared to leave me to clean. I can only be mad at myself. I've been cleaning relentlessly all week. I have until the end of the month to get the apartment together but she wants to do a walk-through BEFORE I leave. Which is making me nervous. If she decides to evict me before I can clean up.

OP, there's a difference between being evicted and not having your lease renewed.

Before you are evicted, you will get a notice to quit. If you leave when asked to leave, it won't be an official eviction.

Even if you're not done when she does the walk-through make it clear you're good for the repairs and will work further after the apartment is emptied if needed. And then DO THAT. Don't let the eviction get documented if there's any chance to avoid it. And be a stand up guy in the situation you're facing. Learn from this.

Thank you R16. I'm trying not to leave on bad terms. I can get the apartment clean and hopefully she'll let me work out a payment plan before any more decisions are made. R17 I agree with you. Its going to cost them a lot more to evict then to just let the lease run out. I've already signed a move out notice that can't be revoked. I'm definitely leaving on April.

If you’re in any major city, OP, it takes WORK to be evicted. MONTHS of time as the notifications and litigation plays out. So if you’re in one of those areas no one will hear a millisecond of whatever story you concoct.

You should have brokered a deal to voluntarily vacate the apartment to avoid court. But that would be too much for you: any shred of responsibility and self-awareness, that is.

R9 here. My earlier post was in the typical DL spirit, but reading OP @ R15 makes me want to take a time out.

I think you’re seeing how hard it is to do the right thing, but also the benefit of doing it too. I hope you’re able to get the place cleaned up, be honest with your landlady, and engender the slightest bit of grace from her. Hopefully she’ll work with you and you can stay, but if not you can at least know you did your best.

I ended up skipping out on my first solo apartment after 1.5 years. I had gotten behind on rent and left before what I thought would inevitably happen. It definitely fit the pattern of my life at the time, and, to this day, one against which I measure my actions/behavior.

If you have get an eviction on your record no decent apartment is going to rent to you.

Your options become looking for sketchy, possibly illegal housing that doesn't run many checks, or trying to rent a room with someone when the place is in their name.

Connect with a tenant organization. They will have informed frame of reference to advise you on the implications from an actual eviction (which I agree, takes so much time and effort that it probably won't happen in this instance.)

Your landlord is in the business of making money. So if you clean the place up that saves her money. If you come to some agreement to make good on part or all of the back rent, that gives her money. If you move out, she can start renting to someone who will actually pay. All these are good things, from her perspective. She's never going to like you or give you a glowing reference but at least you can mitigate the damage by trying to clean up your various messes.

Final piece of advice: don't shit where you eat.

About cleaning: I once had a landlord who charged me $25 for not dusting UNDER THE REFRIGERATOR. I had made the rest of the place scrupulously clean. It was a dick move through and through. It wasn’t even personal because I’d never had any negative encounters with them. They did it because they could.

I told my next landlord about it in a casual conversation. You can see what’s coming, right? He did it, too.

They will do ANYTHING to keep your money. You should clean because, presumably, it was clean when you moved in but keep all your expectations rock bottom low.

OP, if your lease is expiring in a few weeks, I doubt she will take the time and expense to evict you. If anything, she must've given you legal notice letting you know she doesn't wish to renew the lease with you on April 1.

If you are worried about future damages to your name when you want to rent again, don't worry - the pandemic has screwed up everyone the past few years and many have lost jobs and fallen months behind on their rent. Most courts have been lenient with these apartment dwellers - so just blame the pandemic.
