North Dakota Could Jail Librarians Who Don’t Comply with Anti-LGBTQ+ Book Bans

North Dakota lawmakers have introduced legislation to ban books that contain “sexually explicit” content from public libraries, including a provision that could jail librarians if they don’t comply.

While Republican legislators around the country have introduced similar bills over the past year, most apply only to school libraries. House Bill 1205, however, would ban all public libraries from stocking “sexually explicit” materials in the name of protecting children, meaning that readers of all ages would be banned from accessing LGBTQ+-inclusive texts, which are largely what these bans restrict.

Introduced Tuesday by North Dakota House Representatives Mike Lefor and Vicky Steiner, the bill would redefine “explicit sexual material” to include “deviant sexual intercourse,” “sadomasochistic abuse,” “sexual perversion,” “sexual identity,” and/or “gender identity.” Neither “deviant” nor “perversion” are defined in the bill, a likely intentionally vague wording that could apply to just about anything. The public will be allowed to submit removal requests to libraries regarding books that violate the bill. Libraries must individually develop review processes for these requests, and if found guilty, they would be forced to remove the book within 30 days of receiving the request. Those who are found guilty of stocking such books would be guilty of a Class B misdemeanor, which carries a penalty of up to 30 days in jail, a fine of $1,500, or both.

Lefor cited the graphic novel Let's Talk About It: The Teen's Guide to Sex, Relationships, and Being a Human as one reason why he put the bill forth, according to the Bismarck Tribune. Referencing illustrations of nudity, Lefor stated that he thought the content was “disgusting,” and that public libraries “should put it in a restricted area where (children) need to get permission from their parents to take a book out like this, but they're offering it to junior high school kids ... and when we grew up, we didn't need things like this.”

“This is not a way to raise our kids, and we have to do everything we can to make sure that this doesn't get into the hands of children, especially without their parents' knowledge,” Lefor told the Tribune.

However, Allan Blume, the vice president of North Dakota’s Valley City Barnes County Public Library Board of Directors, defended the book’s educational value. “If I was a 13 or 15 or 17-year-old who had not gotten the education through the school system or through an interested and engaged family,” Blume said in comments reported by Valley News Live, “that book serves a crucial, crucial function.”

The bill comes just days after North Dakota lawmakers introduced a bill that would ban doctors from providing minors with transition-related healthcare, including hormones, surgery, and puberty blockers. The so-called “Help Not Harm” bill would strip doctors who provide such care of their licensing, and would allow patients who have been “harmed” by such care to take retroactive civil action against doctors up to the age of 25.

Both book bans and anti-trans healthcare bills proliferated in 2022. The American Library Association reported in September that 681 attempts to ban or restrict library resources had been filed in the first eight months of 2022, the highest number in decades. Fifteen bills restricting trans healthcare were introduced in 2022, with even more already introduced in state legislative sessions this year.

Sadly, not a surprise. As much progress as we’ve made we still have so much further to go. There has always been a strong streak of narrow-minded anti-intellectualism in this country. We’ve had to engage in this battle over and over again throughout our history. Hell, the assault on evolution by creationists is still going on 100 years after the Scopes Monkey Trial.

And, yes, we have to battle this every step of the way. It would be nice if we would have the backing of the Supreme Court, but since tRump was allowed to pack the Court with three reich-wing bigots to join the two who were already there, any assistance from them is shaky at best — but more likely nonexistent.

In fairness to Christianity per se and not necessarily its purported adherents, the New Testament supercedes the Old.

That is to say, the alleged historical accounts of adultery, incest, and assorted debaucheries of the OT are not the tenets of the NT and thus not of Christianity, Jesus being only in the NT.

E.g., The God of Smiting One's Enemies is superceded by the Prince of Peace and Loving One's Enemies. E.g., The God of Killing Jezebel is superceded by the Jesus of Protecting and Forgiving the Adulteress Against the Hypocrites. And so on.

I certainly did grow up around some ignorant people. Do you know what horrible thing the folks in my neck of the woods did once when I was a young ‘un? They burned books!

The townspeople made a big pile of 'em out in front of the library, and they threw a torch on top. Only, Big Daddy was outraged. He fought his way through that crowd, clawed his way to the top of that pile, grabbed that lit torch, and turned to that crowd and said, "What are you people doin'? This is lunacy. I was sure that North Dakota must be the least visited state. There's nothing there and it's not on the way to anywhere else, but apparently the least visited are Alaska, Montana, Wyoming, Delaware and Vermont. WTF? Why are tourists flocking to North Dakota over all those places which seem much more to be vacation destinations (maybe not Delaware so much, but it has some nice beaches). I don't get it.

Yeah, ND probably has some beauty spots, but all those northern states are outdoorsy and have skiing. I’ve just never heard of anyone vacationing in North Dakota. Must be a well-kept secret.

I think the MAGATs know full well that kids are exposed to everything online and not from library books. They just get upset about their “tax dollars” going to something they don’t like, plus the thrill of bullying librarians, teachers and school board members.

This all stems from the trans and radical gender movement which has parents freaked out. Yes r47. That was added to schools mandatory reading lists in some states for kids as young as 8 years old, which is what has caused this strong pushback. There was already pushback but now it’s stronger.

Why should anyone be able to tell anyone else what they can read at a public library?? It’s YOUR job as a parent to worry about what YOUR kids read, not someone else’s kid.

I recently went to my public library’s public board meeting where this little group of weirdos were trying to get about 20 books removed from the library. They got to speak first, but then they were floored when many more people got up to rationally explain why books shouldn’t be banned. The lead book banner dude was a TOTAL FREAK and doesn’t even have kids…but was passing around images from graphic novels. He tried to show them to me and I looked right at him told him to get out of my face.

The library board ultimately decided to not ban or remove any books. Sadly, I don’t think it’s over and I expect there will be more book challenges. I don’t even use the library that much, but I do not agree with censorship in any form.
