Justice David H. Souter
David H. Souter is one of my favorite Supreme Court justices. For such a quiet, reclusive, and classy man, he is one of the most controversial justices of all time.
From a small New Hampshire town, Souter represented the Bush/Baker uber wealthy New England Country Club Republicans of a different era. He does not own a computer, cell phone or TV, only listens to classical music/opera, has a massive library of classic literature in his NH farmhouse, and has a strong interest in civics education.
As Republican ideology shifted, he kept his same moral principles. He did not leave Republican Party, Republicans left him. Because of Souter, the Court has become more politicized.
I respect him for not catering to the ultra-right wing viewpoint.

The high court nominee lived with his mother in their weatherbeaten farmhouse until she moved into a retirement residence in nearby Concord several years ago. Until Souter went to Washington to prepare for the hearings, he continued to live in Weare and visit her every Sunday

He's really an anachronism. He had a sterling reputation when he was in DC and seems to be what everyone thinks he is. He also seems to have pretty much lived life on his own terms, which I admire, as it is fairly rare, particularly when done in a way that does not offend others. He left SCOTUS at 70 and never looked back, although he does sit on the bench with the First Circuit Court of Appeals as he is allowed to do. He is very physically active, still hiking. I can see him easily living beyond 100 years.

He is totally no frills. I was intrigued about his NH farmhouse and googled it. It almost looked like it was abandoned. I was surprised at the run down appearance...needed paint and repairs. He has many books and I read that the house couldn't support them all....so he moved. He's an interesting guy.

Souter rarely, rarely gave interviews but not too long after he retired, he gave an interview to one of the national news shows and gave a tour of his new farmhouse. As he pointed out a large storage area, the interviewer said something like "That's a very large closet you have there, Justice Souter."

I would call him a very eccentric man- willfully ignoring or eliminating modern convenience and tech. I admired his integrity. But I suspect he is a gay man and as such gas not lived to his potential in the drive to a more perfect Union. Somehow I think it is all related- an inability and or rejection of living in the world as it is, in part because he lacks the courage.

Perhaps, marriage isn't important enough to him. It will distract him from higher purposes. He's very "New England" in personality and comportment. He just might be asexual. If he was gay, the GOP would've "outed" him years ago, as revenge. They despised his liberal leaning Supreme Court decisions.

R49 what does the "very New England" personality and comportment mean?
He had a very interesting judicial philosophy- stare decisis. He looked at precedent alone, not textualism v. originalism. John Harlan Marshall II was the only other justice to have that philosophy. Souter voted "conservative" on many Court issues, too.
R50 he was an only child to wealthy parents. His dad was a banker. He also invested early in some New England bank stocks that took off. He had a very good stock broker. He was also a frugal New Englander. Yes, he was the richest justice when he retired.
by Anonymous | reply 54 | August 31, 2022 1:27 PM

R54, "New England in comportment and personality" just means he's a Yankee. They are known for "shrewdness, thrift, ingenuity, and conservatism." (Quoted words from Britannica.) Another good example is Katharine Hepburn.

R54 he was not wealthy growing up. Not all bankers were wealthy, although his family was comfortable. He did invest in banking stock and knew when to get out. That makes him worth $6-7 million on his own. Plus being frugal as you mentioned. Thus, once out of DC, he could dump that dilapidated farmhouse buy a much nicer property. He has wifi capability and, since he has neighbors who welcomed him, he likely kept whoever did the yard work of the previous owner.

It's all bullshit, and it's bad for ya. Back in that era, people were just as nasty as they are today. We all just had thicker coats of naïveté, and convinced ourselves that everyone was friendly.

I worked with the son of one of the other justices. He said Souter just didn't get his work done. Took way too long to write opinions. That's why he retired 'early.' He just couldn't hack it. He had led a relatively low-stress life in NH, and couldn't adjust to the workload/responsibility.

With the exception of his interest in civics, none of these things are qualities I want in a Supreme Court Justice. I admire Souter too, but I don't think someone whose life is so far removed from regular people -- like people who need a computer to do their job, or need a cell phone to get and keep a job, let alone people who will never own massive libraries or NH farmhouses -- I don't think someone like that needs to be entrusted with decisions that will effect millions of regular people in their everyday lives.

I want a person with AIDS for president and I want a fag for vice president and I want someone with no health insurance and I want someone who grew up in a place where the earth is so saturated with toxic waste that they didn’t have a choice about getting leukemia. I want a president that had an abortion at sixteen and I want a candidate who isn’t the lesser of two evils and I want a president who lost their last lover to AIDS, who still sees that in their eyes every time they lay down to rest, who held their lover in their arms and knew they were dying. I want a president with no air-conditioning, a president who has stood in line at the clinic, at the DMV, at the welfare office, and has been unemployed and laid off and sexually harassed and gaybashed and deported. I want someone who has spent the night in the tombs and had a cross burned on their lawn and survived rape. I want someone who has been in love and been hurt, who respects sex, who has made mistakes and learned from them. I want a Black woman for president. I want someone with bad teeth and an attitude, someone who has eaten that nasty hospital food, someone who crossdresses and has done drugs and been in therapy. I want someone who has committed civil disobedience. And I want to know why this isn’t possible. I want to know why we started learning somewhere down the line that a president is always a clown. Always a john and never a hooker. Always a boss and never a worker. Always a liar, always a thief, and never caught."

Every summer, Supreme Court Justice David Souter would drive from DC to his native New Hampshire. One day he stopped for lunch in a diner. A stranger and his wife came up to him and asked, "Aren't you on the Supreme Court?" Souter said he was.
"You're Justice Breyer, right?" said the man.
Rather than embarrass the fellow, Souter simply nodded and exchanged pleasantries, until he was asked an unexpected question. "Justice Breyer, what's the best thing about being on the Supreme Court?"
The justice thought for a while, then said, "Well, I'd have to say it's the privilege of serving with David Souter."
