by Anonymous | reply 135 | August 9, 2022 1:06 AM |
As you probably know, r130, the question would be whether the affadavit supporting the request for search warrant particularized, for probable cause, the Mar-a-lago surveillance cameras as things to be siezed and searched.
I know that was awkwardly phrased but I still think it's a question.

Is FoxNews having a meltdown?
by Anonymous | reply 137 | August 9, 2022 1:10 AM |
The search warrant would have been based on work done at DOJ, who would have applied to a federal judge, who would have reviewed the application and signed the search warrant, which was then executed by the FBI. Within DOJ, that search warrant application would have been created by career staff (not political appointees), and then reviewed by many levels of supervisors, likely including the Attorney General personally.
Popehat on Twitter (who is trustworthy, unlike a lot of hype viral Twitter accounts), noted two more things that stand out: the feds would need a good reason why the search was likely to turn up evidence now, so there had to be a reason why they thought Trump hadn’t yet destroyed everything (strange to me). Second, and more importantly, the feds would not have proceeded with a search warrant now if they were still uncertain or trying to decide about the appropriateness of bringing a case against a former President. DOJ would have spent a long time and many discussions deciding whether for policy reasons (like preserving the appearance of political impartiality), they should avoid going after Trump. They would have made that call before taking such a public step. So the green light is on.
by Anonymous | reply 138 | August 9, 2022 1:10 AM |
THREAD: “What’s the difference between this and Watergate?” Donald Trump raged in a statement Monday night after FBI agents.
Well, as a Watergate and FBI historian, four things stand out to me:
1) The idea the FBI launched a raid on a former president would have been approved and monitored at the highest level of the Justice Department; hard to even imagine how high the bar of probable cause must've been for the Bureau to initiate such a politically sensitive search....
2) A search warrant means an independent federal judge ALSO signed off on the probable cause and, independently, believes evidence there was likely a crime committed AND that more evidence would be found at Mar-a-Lago. That's huge too.
3) The fact the search apparently didn't leak until basically when word came from Donald Trump himself shows the FBI and the Justice Department conducted this search by the book and a high degree of integrity. No leaks? Impressive. Surely only a small team knew inside DOJ....
4) Taken together, this is one of the most significant, sensitive, and politically explosive actions the US Justice Department and FBI has ever taken—one of a tiny handful of times it's ever investigated a president.
[bold] Bottom line: The FBI & DOJ must've known they had the goods. [/bold]

Fox is going on and on about the midterms. Claiming the FBI and DOJ are using this raid to influence the midterms....again. Trump is a former president. He's not on the ballot motherfuckers and this is not 2024 or a presidential election. Did I miss something? What does it have to do with the midterms if the DOJ raids the home if a former president? We don't care about his bought endorsements and he should be in jail anyway and not thinking about running again.

Here's the NYT story, archived (no paywall).
Trump says nothing like this has ever happened to a US President. Now he knows how we feel. We never had a President like him before.
“These are dark times for our Nation, as my beautiful home, Mar-a-Lago in Palm Beach, Florida, is currently under siege, raided, and occupied by a large group of FBI agents,” Mr. Trump said in the statement. “Nothing like this has ever happened to a President of the United States before,” Mr. Trump said.

If this were only about the boxes that he improperly removed from the White House in January 2021, it is not likely that they would have executed a search warrant in this fashion. It must be more than that. And if Merrick Garland signed off on this — and he did — they must be absolutely certain of the implications of the materials they were after.

Garland crawled out of his hidey-hole and spoke on television to say nobody is above the law the other day for a reason, and this was probably it. He and this current FBI would not execute a warrant on Donald Trump unless they are looking for something specific.
My guess is Trump was selling documents or going to sell them.

I'll be very surprised "if nothing's found", with good reason.
Your statement here would require me conclude that Merrick Garland authorized the affadavit and request for search warrant based upon shaky probable cause and because they thought a federal judge would just say,

The FBI simply executed the warrant (as they do for DOJ search warrants). The DOJ is the government entity that applied for and received the warrant, so it’s the DOJ running this case, and which could explain what was in the warrant. But the reason no one heard about this in advance, including the White House, is most of the people who work on this don’t talk or seek fame or even post on LinkedIn. They may have moved quickly here because of the risk of document destruction or to avoid doing this too close to an election.

With the revelation about 10 days ago or so that Trump was indeed being investigated, he should have known this was coming.
Wonder where all those "arrest Merrick Garland, he's letting Trump get away with this" panic posters are right now? I remember one still posting a couple of days ago, pretending like there was no investigation into Trump when there absolutely was.

R270 whether that can be applied to a President-elect would definitely be litigated in the courts. And this SCOTUS would side with Trump.

They didn't side with his election fraud claims. This SCOTUS reports to the Federalist Society and Mitch, not Trump.

It depends on what's found in the raid and what other evidence they have, r276. If something bad enough is found, or there's too much evidence to ignore and it's made its way into the papers, this SCOTUS will happily throw Trump under the bus to save the GOP.

He wanted the original documents, and I can't think of any reason why he would want the original documents, unless he was going to pass them on to someone else who wouldn't take a copy.

From various talking heads on MSNBC: Trump was told not to remove documents from the WH; he removed many boxes of highly classified documents. He returned fifteen boxes of documents and promised in writing to return anything else that turned up. He broke that agreement; he in fact kept quite a few classified documents. Therefore, he repeatedly demonstrated intent to mishandle classified documents. There are also those numerous photos of documents he ripped up and tried to flush.
R292, there could be a lot of information, such as recordings or readouts of phone calls, that he would never risk returning to the government because they implicated him (and/or other people) in crimes.

It was me that formed the basis of a free and democratic society when European countries were still dominated by corrupt hereditary aristocracies. This permitted the USA to prosper, which in turn led to the USA quite literally saving the UK and other western democracies from being conquered by fascists. (The US funded the British war effort right from the start, for instance, and Fed and armed the country as well).
So, you’re welcome!
by Anonymous | reply 304 | August 9, 2022 3:27 AM |

Smart to send the feds in for the documents, as per Chuck Rosenberg on MSNBC, all documents can be seized. The agents don’t have to verify that the docs are the classified docs the archives want when they seize them. But whatever is found can be used in investigating any and all crimes. We may find more shenanigans.
Either this was a big deal and he was selling classified docs to the highest bidder, or it was just an easy way to justify a seizure of ALL documents in his possession because the big dumb ass couldn’t keep his desk organized an pissed off the Archives. You don’t fuck with librarians.

Why’s that? Because European countries are always one step away from sliding back into fascist war-states. Our democratic institutions are stronger, and trump failed.

[127] Frank Figlucci on MSNBC just revealed that the FBI is required to give the former President's Secret Service security detail notice that they would be entering a former president's residence. Considering what's been revealed about the Secret Service erasing text messages, I feel certain the SS would have used that notice to get rid of anything that might reflect poorly on their Fuhrer.

R277/R278 Depends on the timing. If Trump wins the primaries for 2024 and manages enough voter suppression to win the election, SCOTUS will absolutely side with him with the Federalist Society's enthusiastic support.
If the issue gets to SCOTUS before the primaries, they might throw Trump under the bus if that’s what the GOP wants. But they’d arguably have to violate the ripeness doctrine to do it (not that they wouldn’t). Besides that, what are the chances he’d be convicted that fast? The primaries are over 1.5 years from now. If Trump wins the primaries, the GOP will want him to win the election no matter what it takes.

I hope Homeland Security is watching the right wing junk groups that are chatting quite angrily on social media tonight. Some of them are talking about taking up arms again!
Then you have repub politicians and right wing hosts who are further inflaming Trump voters with propaganda. Those assholes should all be charged with incitement if something does happen again
McCarthy is a real piece of shit threatening Garland tonight. 1 of the most pathetic human beings ever to be in US government
I do hope mainstream media keeps reiterating the facts that this FBI search warrant was properly predicated and carried out. We know the DOJ and FBI will not comment on ongoing investigations. We also know the Biden admin is not going to get involved either. Unfortunately this creates another "narrative vacuum" for Trump, repub politicians and right wing media hosts/commentators to fill up with lies

Why exactly should a single Democrat even abide by whatever bullshit McCarthy has planned for his temper tantrum? The Hunter Biden stuff has been kept alive for this exact purpose. It was always simmering in the background so they could deploy it the second Trump started to be officially investigated. It's not really doing the job of distracting that they thought it would, probably because they've been jabbering about it for so long that no one cares anymore.

Of COURSE they can all be wrong, you idiot. Even supposing it was true that people said something so ludicrous "every time" you turn on your TV, what "people say" has nothing to do with evidence or facts, let alone truth. That's why people laugh when Trump says "Many people say..." : they know it means "I just pulled this out of my ass."
At one point "everyone" said Zeus was angry with them and that's why Athens got the Plague. At one time "everyone" said the Titanic was unsinkable. At one time "everyone" thought tuberculosis could be cured by mountain air. Please let us know if you think all of those people couldn't be wrong.
(Because a lot of people on here can't do basic Comprehension, I probably need to forestall a long argument by pointing out now that I am not a MAGAT but a lefty, who loathes hyperbole and likes evidence.)

R292 and R297 raise excellent questions and thoughts.
Consider Trump’s penchant for characterizing treasonous and illegal activity as extremely good or innocuous. His attempted blackmail-for-weapons extortion of Zelensky was, as he described it, “a perfect phone call.” (Ditto the eventually uncovered recording of his attempt to corrupt votes in Georgia.)
The fact that he referred to the never released communication from Kim Jong-un as “a beautiful letter” makes me think it more likely it was seditious. Trump would want to keep that out of his successor’s hands. He might keep it for vanity, but there would be no duplicates.
Ditto the only copies of very damaging dossiers about certain individuals.
The value of some documents may come, not just from the explosive information they contain; but also from the fact that no one [italic] else [/italic] has them.

The only thing that every single one of those Repub senators is going to be known for is that they failed to indict Trump in both of his impeachment trials. Trump broke the law when he tried to go after Biden through Ukraine. It's the Republicans as much as the Dems going after Trump at this point. That comment Eric made about being stabbed in the back was very telling. The Dems wouldn't be considered to have stabbed him in the back, they are just doing their damn jobs. It's the Republicans who are now having to work to remove the filth. They are going after Trump and the whole family knows it.
It's being reported that they broke into his safe. This is more than about those boxes of documents he stole.

In the morning light I am still hoping that this is something more than he just took some classified documents with him when he should not have.
Biden just won the biggest victory of his career and should be taking victory laps and he and prominent Democrats should spend these next two weeks working the news cycle and explaining all the wonderful things contained in the Inflation Reduction Act, with particular aim at-risk Congressional seats where that message can help.
Instead it seems that we have:
(a) Allowed Trump and his supporters to take over the news cycle (yet again) as FBI and Democrats can't really comment while Trump gets to bitch and moan and spread lies
(b) Energized the GOP base that was starting to slip from Trump's grip and feeling defeated once Manchin caved
(c) Created a scenario where independent voters may feel the FBI was being vindictive because taking some documents unrelated to Jan 6th or other prosecutable offenses is just not going to seem like that big a deal. Yes, it is illegal, but it seems relatively minor in the scheme of things, especially if there is no evidence he was trying to sell them, just wanted them as souvenirs

Judge who approved FBI raid on Mar-a-Lago once linked to Jeffrey Epstein
The Florida federal magistrate judge who signed off on a search warrant authorizing the FBI raid of former President Donald Trump’s Mar-a-Lago resort left the local US Attorney’s office more than a decade ago to rep employees of convicted pedophile Jeffrey Epstein.
Sources tell The Post that Judge Bruce Reinhart approved the warrant that enabled FBI agents to converge on the palatial South Florida estate on Monday in what Trump called an “unannounced raid on my home.”
Reinhart was elevated to magistrate judge in 2018 after 10 years in private practice.
Months after his appointment, the Miami Herald reported that he had represented several of Epstein’s employees in connection with the sex trafficking investigation against the financier.
According to the paper, Reinhard resigned from the South Florida US Attorney’s Office effective on New Year’s Day 2008 and went to work for Epstein’s workers the following day. In 12 years as a federal prosecutor, according to his official biography, Reinhart “managed adocket that covered the full spectrum of federal crimes, including narcotics, violent crimes, public corruption, financial frauds, child pornography and immigration.”
The Epstein employees Reinhart represented, by his own admission to the Herald, included Epstein’s pilots; his scheduler, Sarah Kellen; and Nadia Marcinkova, who Epstein once reportedly described as his “Yugoslavian sex slave.”

My understanding is that much of the material found there earlier was classified at the highest levels. Special Access Program / Trigraph level stuff that only a few people get read in to. There's a special court system just for this
The fact that MAGA world is freaking out over this is sad and scary at the same time. There was obviously a crime committed here: namely 15 boxes of boxes of deliberately mishandled materials. This goes WAY beyond someone having a private server.

The GOP establishment in Congress and the Party will support Trump for the simple fact that there is serious dirt on all of them and he has it and will use it. If he really believed that, surely that's an undeniable case for invoking Section 25? There is no reason to take 15 boxes of classified papers to Mar-a-Lago unless he was criminally planning to sell information therein.
One can suspect “Pootin” already knows the content and has copies. “Pootin” may have had a hand in “ordering” the boxes to be brought to Mar-a-Lago. Some material may have been “sold” to other countries, adversaries, or international trafficking individuals and groups. Arms dealers may be clients,
U.S. intelligence suspected what was happening and injected agents into Trump’s transactional schemes.

There was something on CNN last night when the story was breaking as to how DOJ/FBI avoid doing anything that can be interpreted as political in the 60-90 days leading up to the elections. Now, subtract 90 days from an early November date. If that's the case, they waited until (literally) the very last moment.
What worries me is, can't Trump as then- president say he could declassify anything he wanted? And then argue he took whatever documents home because he lowered their importance. This is a slippery fucker we're dealing with here
No. There's no "slippery slope." Certain broad classes of information related to sensitive matters are presumptive for classification. Determining that something within such a group of records is not classified is usually not done except by specific request which must be reviewed if prior to their routine release schedule (5 years, 25 years, 50, 75...) and the documents reviewed by court order to release something incorrectly classified. It's a complicated process, seen in shorthand version in FOIA requests for FBI files on, say, Frank Sinatra.
Beyond national security issues, the National Archives has very clear guidelines for preserving every fucking thing in all formats. There are records maintenance people at all levels of the Executive Office charged with ensuring compliance with preserving fucking everything.
That is why Hillary Clinton and her private email server was a serious matter, because it introduced the possibility of selection - cherry picking what to preserve and what not. Granted I never thought Clinton was being malacious in her email affairs, but the fact of her laziness, incautious disregard of security interests, and brassy "we will fi it our way" disregard for what are simple requirements for keepings records: keep fucking everything, delete nothing, throw nothing seat, and let Archives do what they will with it. Clinton, forever quick to outline the importance of Watergate in shaping her career and her respect of protocols should never have let her private server crisis happen. She knew better, she just couldn't be bothered with the pesky details.
Trump, however, is an entirely different kettle of fish. Sloppiness plays the least role; it's blatant to theft, ,"editing" of his official record and covering his misdeeds, and a fundamental contempt for any level of process.
by Anonymous | reply 527 | August 9, 2022 4:37 PM |
Trump flew in Epstein’s plane and partied with him. The Republicans never flesh out their feeble distractions.
And among all their “outrage” they never acknowledge that If he committed a crime, then there are consequences. They view everything as a personal attack, but I don’t think their audience cares anymore. Trump is a fat crook and the public across all parties know this.

The other option for them is to offer him a get out of jail free card, as long as he keeps his mouth shut. If they scare him enough, he'll do it.
by Anonymous | reply 533 | August 9, 2022 6:05 PM |
r517, he fought it in the courts. It was just last January that SCOTUS said he couldn't keep the remaining 5 boxes of files that he wanted. He said he had executive privilege and could keep them if he wanted, and SCOTUS reiterated that no, executive privilege isn't given to a person, it's given to the current office of the POTUS. They'd previously ruled that back during Watergate when Nixon was suing to keep documentation he had away from the archives, and they ruled against him, too.
So Trump had been told in January that he lost his case, and still held on to all this paperwork. I cannot understand why he held on to it, exposing himself to an FBI raid like this that could incriminate him even more.

The GOP is fed up with Trump and his grifting ways, siphoning all the donations for himself and not sharing with them while holding his hand out for the GOP to give him more money to win "for them". That is why they prefer someone like DeSantis, who is a team player.
All they need is some sign that he truly lost the Deplorable demographic.

Here we are at the end: it just occurred to me that Donnie Boy has NO DOUBT been amassing compromising dirt on any and all that he possibly could, and probably for decades. He MUST have to keep all this delicious filth in one central location in order to hope to be able to keep track of it. So, isn't it likely to have ALL been in that safe he's complaining about? I think it's likely.

Trump's Secret Service got a 45 minute heads up from the FBI. Eric was informed right away and called Daddy Trump long before they actually arrived. It was not a surprise to Trump by the time it happened. Plenty of time to hide things.
Empty safe? Sure Jan.
