They may have been pardoned, but it absolutely was a hoax, intentionally perpetrated by Richard & Mayumi Heene, R8. They hid Falcon in the house, and lied to law enforcement and the media, telling them they believed the boy was in the balloon, when they full well knew he wasn't.

Richard Heene was sent to jail for ninety days, and was fined $42,000. At one point, his wife faced deportation, which didn't happen.
