Elon Musk says Tesla will 'immediately' leave California because of forced shutdowns

After a week of decrying coronavirus shelter-in-place orders that have left Tesla's main factory shuttered and unable to produce vehicles, Elon Musk says the company may move its factory out of the state.

"Tesla is filing a lawsuit against Alameda County immediately," the chief executive said on Twitter Saturday morning. "The unelected & ignorant 'Interim Health Officer' of Alameda is acting contrary to the Governor, the President, our Constitutional freedoms & just plain common sense!"

That was followed up with a threat to move Tesla's headquarters outside the state.

"Frankly, this is the final straw," he replied. "Tesla will now move its HQ and future programs to Texas/Nevada immediately. If we even retain Fremont manufacturing activity at all, it will be dependent on how Tesla is treated in the future. Tesla is the last carmaker left in CA."

It wasn't immediately clear if a suit had yet been filed, or in which court Tesla will file the lawsuit. Most state and federal courts are closed on weekends and do not allow filing. In a subsequent Tweet, Musk alsourged shareholders to file a class action suit for damages caused by shutdown.

Tesla's press relations department did not immediately respond to a request for comment. Alameda County did not immediately respond to a request for comment.

Alameda County — the East Bay locale which includes Fremont, California, and Tesla's gigafactory about 30 miles southeast of San Francisco — extended its shelter-in-place order on April 29 "until further notice." Local authorities have not allowed Tesla to reopen the factory, and all manufacturing remains prohibited under the order.

The San Francisco Chronicle reported that Tesla was planning to resume some manufacturing operations at the factory as soon as last Wednesday, May 6. Local officials said it did not have permission to do so.

"Right now, the same health order is in place so nothing has changed," Fremont Police Department spokeswoman Geneva Bosques told Business Insider at the time. "Operating the assembly line was determined early on to be a violation."

Last week, following Tesla's first-quarter earnings announcement, Musk decried the shutdowns as a substantial risk to the company's financials.

"Frankly, I would call it forcible imprisoning of people in their homes against all of, their constitutional rights, in my opinion," he said on a conference call. "It's breaking people's freedoms in ways that are horrible and wrong and not why they came to America or built this country. What the f---. Excuse me. Outrage. Outrage."

"If somebody wants to stay in their house, that's great and they should be able to," he continued. "But to say they cannot leave their house and that they will be arrested if they do, that's fascist. That is not democratic — this is not freedom. Give people back their goddamn freedom."

Some states, including Texas, Georgia, and others, have begun to slowly allow certain businesses to re-open in recent weeks.

Musk praised counties neighboring Alameda, like San Joaquin for what he said were more "reasonable" responses. In a podcast released May 7, he told Joe Rogan that the company had learned from the coronavirus in China, where it briefly forced Tesla to close its Shanghai factory — a claim he repeated on Twitter Saturday.

"Our castings foundry and other faculties in San Joaquin have been working 24/7 this entire time with no ill effects. Same with Giga Nevada," Musk said. "Tesla knows far more about what needs to be done to be safe through our Tesla China factory experience than an (unelected) interim junior official in Alameda County."

As Musk began to complain about factory shutdowns in April, workers at Tesla's Fremont factory told Business Insider that the comments made them anxious.

"I'm for going back to work, but only if it is safe for me, my family, coworkers," said one production employee. "I don't feel like I'm being forced to stay home or that my freedom has been taken away. It's for the good of California."

California, as the world's fifth largest economy, is probably not desperate to hang on to "the last carmaker" in the state.

Musk may be attracted to Nevada or Texas because of more relaxed environmental laws, fewer taxes on big businesses, and l cheaper workforces.

Alameda County's temporary shutdown of this plant gives him the perfect opportunity to make a move out of California seem like something he was "forced" to do and not something he'd already had his mind on for some time. His public tantrum about it would also appeal to the TX and NV populace.

R69 it has more to do with mental instability than financial. I worked in the service industry for some time and the worst customers I dealt with were usually from when I was working in an east coast suburb that is the 2nd or 3rd wealthiest in the country. Barely tipping or throwing shitfits over minor stuff was par for the course. This was kind of a "new money " area so maybe that played a part too.

My husband was all in on Tesla. He was going to buy one. Tesla was going to have a $37k affordable loaded Tesla....like, any minute now. He fucking PAID to reserve a test drive. They kept cancelling it & rescheduling. “We haven’t got one available locally. They sell out so fast!”

I kept asking him “Got that $37k fully loaded electric car yet?”

Notice he is threatening to move his "headquarters" not the production plant. He has only two functioning auto plants in the world, California and China. The battery plant and car component plant is outside Reno and has a significant part of it leased to Panasonic. He is trying to establish another plant in Germany. It would be suicide to import all his cars and the production plant in Alameda county (Fremont, CA) is a former Toyota/GMC plant that essentially given to him with great incentives to begin production.

There is no need for a second plant in the US so unless he or some "red state" is willing to build a new plant, it is not financially feasible at this time. So he will move the headquarters which by the way is located in Palo Alto, CA which is in Santa Clara county, NOT Alameda county. I don't know the number of employees at headquarters, but I assume it is fewer than 500 people.

He is the typical bully, who likely has mental health issues and he carries clout and media frenzy because of his money, visions and successes. Remembers, his ranting and raving cost him the Board Chair for three years as a settlement with the SEC. Seems like Americans are acquiescing to bullies in business and politics.

Tesla cars are really popular among wealthy liberals.In California it is impossible to go outside in certain neighborhoods/towns without seeing a Tesla before you see a Starbucks. That is not to say that Republicans/Libertarians would never buy one (they are quite popular on those libertarian subreddits full of techie on the spectrum guys) but it is a socially acceptable status symbol for liberals because if they go for the big Rolls/Ferrari/G Wagon they will be sideeyed by other liberals for driving a car that's bad for the environment. This is a way of seeming environmentally friendly while still being able to place your car keys on the bar and show that you're 'someone' . I know 2 power gays who now drive Teslas. When I first met them in 2015 one was driving a G Wagon and the other and his partner had matching Porsche SUVs. I even saw Ms Grace Slick in a Tesla on PCH. She was at the red light beside me outside the Malibu Country Mart. lol.

I simply refuse to hate on Tesla. They made an affordable, powerful, electric car. They are one of the keys to America’s energy independence and they are built here. Elon is an asshole and shelter in place is good for his workers, but damn I’m glad that company shook up the monotony for coming from Detroit and the foreign automakers. Elon is. Small price to pay transition America away from gas guzzling vehicles.

When I lived in LA my drive to work took me through Beverly Hills, past the Four Seasons and then into Subset and last the Beverly Hills Hotel. I always enjoyed the car porn. Everyday I saw Rolls-Ferrari-Maybach-Masserati etc. And those ugggly G Wagons were everywhere. I even have a folder of pictures on my phone that I took of those cars at red lights and then shared with my brother who loves cars even more but never sees any cool ones back home. Anyway, ff, I’m back there 2 years ago and welp much less car porn. Tesla, Tesla, Tesla everywhere. Thankfully those G-Wagons were gone. Last year I saw fewer Teslas and more SUV variations of luxury cars. I saw several Rolls SUVs, Porsche SUVs. I had always just assumed Teslas were a rich person thing and a sort of “limousine liberal” thing. Maybe the US now has cheaper models? Might explain why they’ve fallen out of favor with the rich. I’m back in the U.K. now and I think I they start at like £80,000. I saw one in London once but they’re as rare as hens teeth. I met a guy pre-Corona who was planning a trip to Florida and all he wanted to do was find a way to rent a Tesla. Insurance was his issue I think. That surprised me because the Stang and to a lesser extent the Dodge Challenger are the two dream cars of most British men going over to Florida. I’d they have a bunch of kids then it’s the biggest bus of an SUV they can find Lol

I read an article written by Justine Musk about her relationship with Musk over ten years ago maybe in Vanity Fair or New Yorker. I searched and can't find it. I'm pretty sure Musk had it scrubed.

What I recall:

They met in college where she said he was far, far different from the egomaniacal industrialist he became. She described him as being thoughtful and supportive of her career as writer.

It all changed when the PayPal money started rolling in. He hid finances and Musk and the board strong-armed her to signing a contract that basically excluded her from any financial benefit. IIRC, they lied about the contents of the contract. She found out later during the divorce that PayPal money was off limits to her.

He kind of marginalized her as a spouse and she became the trophy wife appendage. One thing that stuck out is that he kept having her lighten her hair until she was blonde.

The other thing that stuck out was about her IVF pregnancies. She had twins and triplets via two pregnancies. She claimed that Musk only wanted males and the female fetuses were selectively terminated.

Yeah. I can see how Musk got this scrubbed.

Workers Business Insider spoke with said they were nervous that they were at risk of losing their jobs if they didn't comply with the company's orders and report to work.

R159 I don't think it's full-blown mania but I do think perhaps he does have bipolar disorder. I think he's more bipolar II than bipolar I. Bipolar II meaning he never reaches the "high" of full-blown mania of Bipolar I but has behavior consistent with hypomanic episodes. Musk is still able to function in his personal life and as head of his company. He's not having the level of mania which affects his own or others' safety. There is a big difference between manic and hypomanic episode. For a comparison, manic episode is more like Britney pre-diagnosis and conservatorship, that's classic full-blown mania and I've seen it with my patients up close.

Musk also appears to have indications of cannabis use disorder and god knows what other drugs or alcohol issues we don't know of, and I think that would be the most fitting explanation. Though I agree with you, bipolar disorders very likely as well. Substance abuse and bipolar disorder are very common, many self-medicate and end up with substance use disorders. He is an intelligent person who thinks outside the box, you don't get to be where he is without those traits. But some of his statements in public show disregard for his company, very self-serving without restraints or consideration of consequences. Also he likes to engage in multiple projects before hopping onto the next, that's one of his quirks that is in line with bipolar II. With hypomanic episodes, you still get some of the euphoric "high" but able to function in personal and professional life.

Teslas biggest market is CA they give a $2500 tax break for the purchase of each vehicle. The federal tax break for Teslas is being phased out since the company has sold over 200,000 cars. Losing the $7500 tax break plus if CA gets pissed off they could remove the state tax break making the cars more expensive.
