He's banking on two things to get confirmed as AG. First, the Senatorial tradition of confirming one of their own to Senate-confirmed positions. Second, the tradition of granting a president the Cabinet members he requests, except in the most extreme cases.

If the Repukes remain in charge of the Senate, then he will likely get the job without too much trouble. If the Dems are in charge, they could could confirm him but extract a promise that he will stay away from Mueller's probe and leave Rosenstein in charge -- which of course defeats the whole purpose behind Trump firing Sessions. Between Rosenstein and Mueller, it's not like Lindsey could add a damn thing. He has probably not tried a case in the past 25 years, and when he was in the Air Force JAG in the 1980s and early 1990s. he wasn't exactly doing the heavy lifting. And, he's hardly some legal expert -- at best, he's mediocre.
